PCN - Redbridge Pedestrian Zone

Hi,

I received a PCN for entering a PCN zone. The PCN zone begins from 2:15 which is when my car entered (around 40 seconds after the restriction starts)
Is there any room for leeway or potential error with the timing on the camera?

What a money-grubbing PCN ! Served for an alleged contravention at the exact time the restriction starts. Just how many clocks in a car are accurate to the second. In my opinion, this PCN fits into the de minimis category of contravention, but the council, ever greedy for your money, is likely to refuse all reps so you'd have to take them to London Tribunals.

The restriction is after the last GSV view was taken, so if you need to submit reps on inadequate/missing signage then you need to do some legwork. GSV could do with some camera van work here too, as many streets here are totally uncovered.

Did you know the restriction started at 14.15, and your car clock showed just before that, or were you totally unaware of the restriction, and missed the signs ?

There may also be a 'technical' appeal argument unrelated to the alleged contravention. These can, and often do, win appeals on their own. This is because councils have to obey the law, just like you, so if they don't, they can't enforce.

Just an update, the appeal was accepted.

I appealed on the basis my clock showed it was not yet 2:15 and asked for principle of deminimis to be applied.

I also quoted the other tribunal cases which have been discussed on this forum.
