Paid for parking for another car: and got PCN

Hi again,

Today I have got a PCN, was a bit surprised as I have paid for parking, however when I have checked the app, seems I have paid for parking but for my an other car.

What you'd recommend to do? Send them an email explain the situation or making an appeal ?

Look up “keying error” which is a reduced amount that you’ll get invoiced for to cover their administrations costs. As an appeal, yes.

There may be other reasons why the invoices you’ve received are invalid and unenforceable but we need to see them first …..

This is a council ticket, not a parking charge from a private company. I have moved this to the council forum.

You have been served a Penalty Charge Notice by the council who are enforcing parking contraventions using the civil law, under an Act of Parliament called the Traffic Management Act 2004. The process of enforcement is defined in that law and its associated regulations.

The key feature of the process is that the owner of the vehicle has full responsibility in law for appealing or paying PCNs, the person driving the car is irrelevant. Of course most times the owner is the driver.

It would be best if you submitted an informal representation to the council explaining the circumstances and ask them to cancel the PCN as they have lost no revenue at all. You can prove payment. Do not be confrontational as the reason for the PCN is your error.

Post up a draft of your reps here for review before submitting, then after submission, post up their response when you get it. Don't be shocked if they refuse your reps. Most councils reject all informal reps, because they know that if they do, the appellants just cough-up the money, to get the discount and not being "au fait" with the process an the legislation.

Unfortunately not a lot, I'm afraid, unless they ****-up their management of the enforcement process. Such mismanagement can win appeals on its own regardless of the contravention being proven.

It is normal practice to re-offer the discount when refusing informal representations provided they receive these within the discount period. so you'll lose nothing by submitting them.

Today one of your colleagues have issued a parking fine on the car registration number: NA11KFU .

Due of app issue, the payment for the parking went to an other car I own: ND59NPG.

I would like to ask kindly for the PCN to be cancelled, since the parking have been paid.

No, you need to be more polite. Some councils will cancel for a first time honest mistake like this as it's a common error. South Tyneside's policy though is not promising but they will cancel if you didn't display a valid ticket. Trouble is the contravention you have is for not having a valid ticket.

So you need to say:

I am challenging the PCN as I did pay for parking but made a mistake by selecting the wrong vehicle on the PayByPhone app. I selected xxxxxx, which was parked at xxxxxx at the time, instead of the car I was driving.

As this was an honest error I hope you will cancel the PCN on this occasion, and I will ensure I double check my parking sessions on the PayByPhone app in future. I'm sure you've seen people make this mistake before!

I enclose evidence of payment made for the wrong VRM and look forward to your positive reply.

Thank you for writing to us.

 

As you are aware, the Penalty Charge Notice was issued as your vehicle was parked in a car park without clearly displaying a valid pay and display ticket or voucher or parking clock.

 

I note your comments, and I acknowledge that you made payment via the pay by phone service.   You correctly state, that at the time of payment you entered or selected the incorrect vehicle registration number.  When using the service, you must enter the vehicle details as shown on your vehicle.

 

It is also the driver’s responsibility to check all entered information before confirming payment.

 

I appreciate that this may have been an oversight and in view of these facts, I am prepared to cancel the Notice on this occasion.   Please note that I may not be able to take the same approach should you receive subsequent Notices.

 

The case is now closed.
