Hello,

I have received a notice to owner for a parking contravention parking charge notice as listed in subject title.

The date on the notice to owner is the 17th APRIL 2024, I HAVE CHALLENGED FORMALLY BY THE LIVERPOOL CITY COUNCIL WEBSITE TRANSPORT SECTION TODAY.

I was not the driver of the vehicle at this time, however I am the registered keeper.

I have contacted the council by both email and telephone and given them the details of the person that was in charge of the vehicle at the time that the penalty charge was issued.

I am being told that regardless of the information that I have presented to them, that is the registered keeper and responsible for the debt for the parking charge on the notice to owner. Right?

Can this be challenged in anyway?

I have read on all websites regarding schedule 4 protection of freedoms act 2012, and transfer of liability, maybe applicable to this?

Your information is correct: the registered keeper is liable.

Have you had a response to the e-mail? What was the response on the telephone?

You have 28 days beginning with the date of service to pay or make reps against the NtO. By my calculation (please post up the remaining sides of the PCN) the 28th day was yesterday (16th).
Please check the online status of the PCN, report here the status history, and, if the site lets you,  make reps against the PCN today.

If (IF) they treated your e-mail as reps they should issue a Notice of Rejection and may re-offer the discount.

Others here with more knowledge than myself will advise further, but you must take some action today. The next stage of the enforcement process sees the penalty increase by 50%.

Did you get an acknowledgement of your formal challenge?
Please post here a copy of what you submitted and also a GSV link to the location.

You may also wish to enquire of the driver what happened to the original PCN.

All I have had back so far, is a confirmation of receipt email.

Once you have the correct view on the screen, press the 3 vertical dots that are top-right in the black box top left. This then gives you three options. Select "share or embed image". Click on that and then "copy link".  The link is then put into your clipboard from which you can past it into your post.

@Smyler171 well the council photos do not prove any contravention:











The location is here https://maps.app.goo.gl/CHUoi9xyNYgp2BSx8 but even going back as far as 2008 https://maps.app.goo.gl/QDeLqVNokABrwdVe7 the second yellow line clearly appears to have been deliberately blanked-out.

This road appears to be in a Football Match Residents Parking Zone, it doesn't appear Liverpool publishes a map thereof but the burden of proof would be on the council to show that all entrances were properly signposted.

In the meantime I'll get hold of the traffic order.

@Smyler171 well I assume you gave up and paid as we never heard back from you, but it's interesting that it's taken the council this long to provide the relevant traffic regulations orders, which apparently are The City Council of Liverpool Football Match Parking Places and Controlled Parking Zone Order, 2009 and amending orders.

Chances are that if you had appealed to the Traffic Penalty Tribunal, they wouldn't have been able to come up with the TRO in time for the hearing, and you would have won by default.
