Tfl PCN debt collection revoked by the court
« on: »
Hi,
I had a hire scooter (motorcycle) in 2019 where I had 2 tfl camera parking fines but I have never received anything in the post. I only found out about them few weeks ago and went up to almost £900 as per the debt collector agency letter. I have made an a witness statement appeal through the court and last week received the court answer. They revoked the TFL PCN debt collection and recovery. Yesterday, I received the original tfl PCN's and was asked to pay the original charges within 21 days.
My question is. do I have to pay them? one of them was on the dotted red box at 18.58 (2 minutes before I was allowed to park). The other one was at the same place but I parked on the kirb, which is in my understanding for scooter/motorcycle is subjective.

Many thanks guys

The process has now been reverted to the PCN stage, so you can pay or appeal. So you can submit representations against the PCNs and TfL will respond to them as normal.

If you want advice on the PCNs, then please post them up here, and also tell us the circumstances for each one. GSV links to the locations would also be useful too. Redact only name and address on the PCNs. If these were postal PCNs you can also phone TfL and get them to send DVDs of the CCTV evidence. TfL then freeze the process for 14 days.

I have to say I am fairly alarmed at the enormous delay in the process. 2019 to 2025 is six years. If you can, try to find out from TfL when they served the Charge Certificates, and when they registered the debts at the Traffic Enforcement Centre.

OP, post your PCNs and leave in all dates, times etc, deleting only the addressee's details and pl confirm whether they're yours.

Thank you guys. I think I will just pay the £160.00 for both and put it to bed. Thank you again for quick response.

Well. don't rush to enrich them before others have had a chance to comment.  The inordinate delay in registering the debt at TEC is quite out of order, so if you pay, they will continue to think they are immune from their legal duty of fairness.

Do you mean £80 for each, the discount rate?

And can someone please confirm the TFL PCN rates that applied in 2019? I believe it was £130, so the discount rate would be £65 per PCN?

Definitely post the PCNs, there are plenty of potential procedural mistakes that might be found by the experts here possibly including camera authorisation problems (fixed now, but might not have been when these were issued), transfer of liability to hirer procedures being messed up, etc.
