Author Topic: Tower Hamlets PCN - Further Appeal Ignored, Newlyn Bailiff at 3rd party address  (Read 36 times)

Hi all, seeking urgent advice on a Tower Hamlets PCN (prefix TT) Bailiff attended property today.

I received a PCN and appealed in September 2024, which the council rejected. I did not accept the rejection and took the appeal further (intended for adjudication).

From that point on, I received zero communication. No response from the adjudicator, no hearing date, and no Order for Recovery.

I received a letter from Newlyn PLC at a property where I do not reside (the letter was passed onto me). This was the first I had heard of the case since taking my appeal further.

I submitted a TE7 & TE9, however I filled out wrong for incorrectly.. I forgot to resubmit (stupid I know, I have ADHD - not an excuse but hopefully some context as to why this slipped through the cracks)

An agent (Mr. Scotford) visited the address today luckily nobody was in - he left a letter, I was sent a photo of said letter, so I decided to give Mr Scotford a call, I said I needed to resubmit the forms, and that I did not reside and that residence and I have also since sold the car. He was aggressive on the phone, claiming he can remove goods from this third party address even though I am not the resident, and its for them to prove that I do not have any connection to that address anymore. I know this is an intimidation tactic, but it made me really upset, he was condescending, rude and aggressive - and I feel really worried for the people living their.

This evening, I have emailed the correctly filled out TE7 & TE9 to the TEC this evening. On the TE9, I ticked the box: "I appealed to the Adjudicator... but have had no response to my appeal."

I plan to call the TEC tomorrow, first thing. Obviously, I made a massive error in not correcting the form when alerted it was incorrectly completed. I really don't want this Bailiff harassing people at a property I now have no connection to.

I have emailed Newlyn, making them aware I have filled out and sent these forms to the TEC.

So a few questions..

Given the letter from Newlyn in Dec 2025 was the first news I had after my further appeal, how strong is my "Out of Time" application?

Does emailing the forms tonight legally suspend the warrant immediately under Practice Direction 75?

How can the resident (who has lived there 1+ years) best prove they are the sole occupier if the agent returns tomorrow? And how likely is it he will return?

I don't reaaaally want to pay the £515 (who does) but in your opinion should I to put this to bed?

Is there anything else I should be doing?

I can't help but think that your name and address on your V5C Registration Certificate for the car was not up-to-date at the time of the original PCN. All subsequent enforcement documents are sent to that address, even if it is subsequently updated.  Once bailiffs are instructed, their livelihood depends on their being diligent in tracking down the person who received the original PCN.

What contravention was the PCN for.

I'm scared you're going to call me stupid.. You'd be within your right to. But I never received a NOR after this letter. My permit ran out (digital) I appealed based on the fact the PCN was more money than the permit, felt passionate about it at the time. Less so now.

What address is on the car logbook.
