PCN - Gloucestershire - code 34J - Being in a Bus Lane
« on: »
PCN Number = GD30346995
Vehicle Reg = DE70ZTN
Web Code = 783ZX353

GSV = https://maps.app.goo.gl/huekM7gwzrDYyx2Q7

Info:
Exiting a car park (exit showing on the left of GSV streetmap) and immediately turning left, heading in a north-westerly direction, along Albion Street, Cheltenham.

Immediately opposite car park exit, across the street, a sign shows two horizontal arrows facing left and right, and under that, an additional arrow pointing left states Bus and cycle lane.

You can legitimately turn left out of car park. We did so.
But you then have to IMMEDIATELY turn right, or you enter the bus lane.
The no-entry sign is after the right-turn, on the opposite side of the road.
On the drivers side of the road, after the right-turn, is the blue circle bus lane sign.
By the time I saw that, I was in the lane, and had been caught on camera.

The road is 50-70m long.
I did not u-turn because of vehicles travelling against my direction - unsafe.
I proceeded in a north-westerly direction to the end of the bus lane (50-70m), and continued - directly forward - into the now-non-bus-lane continued part of Albion Street.

I have now received a PCN for this action.

I believe that, because I exited the car park, saw the sign to say you can turn left - but then did not know that inferred an immediate right-turn - that I have a legitimate case to ask for non-payment.
I believe the no-entry sign being on the non-driver side, was difficult to see, and advocate there could have been a second no-entry sign on the driver's side of the road too.

Please advise. Thanks.

I've selected this bit from the video - just shows you going past the sign into the lane at pace.

Leaving to one side the question of speed, raised by Stamf, there may be an argument for confusing signage.

As you leave the car park the red No Entry sign is likely catch the eye first before the blue Bus Lane sign.

Does the red No Entry (to all vehicles sign govern Albion Street? I don't see how it can, as blue sign permits 'buses, cycles and taxis to proceed in that direction.
So does it govern Gloucester Place? You might think it does, but it can't,  as the advance warning sign in Albion Street

advise one to use it, as by implication the sign opposite the car park exit..

Might be worth a rep - see what others say.

I have to say the video stretches my credulity that the OP actually exited that car park because the vehicle is moving at some speed, and there is no evidence on there of a left turn from the car park as the kerb by the exit is visible.
Sorry if I'm wrong, but I don't think I am, frankly.

Thank you for your replies.

@Incandescent - you are incorrect. There are 2 exits from the car park - one is in view; the second is just prior to this on the same left hand side, but just out of view of this camera image (check the GSV street view). It is from that exit that we left (I have proof). The "some speed" you mention is far below the 30mph limit, and in line with someone pulling out of an exit.

OK, I stand corrected, but if that is the case, you have more distance in which to see the sign.

I agree the sign opposite the exit is misleading as it seem to show normal traffic moving in both directions, which is not the case.

Another point is that the bus gate sign is mounted very high, far higher than the No Entry sign. Recommendation of the Traffic Signs Manual 2018, is that the bottom edge of signs should not be higher than 1.5 metres. So short distance, and high sign means a nice little earner for the council.

So you could also point out this difference, and say that the council have failed in their duty to erect 'adequate' signage of the restriction. However, note that 'adequate' is subjective, the council will say it is 'adequate, you say 'inadequate, what would an adjudicator say ?
