Newham Council messing up PCN process?
« on: »
Hi there,

The hire car I was using was cloned and I received 5 PCNs from Newham Council. Terrible timing. The whole thing has been horribly stressful but il cut out all the boring legal details and get to the point:

- 4 of the PCNs: I have now been sent a Charge Certificate, but they never sent a "Rejection Notice" for the "Further Evidence" request they asked me for, and which I complied to within 7 days.

- The 5th PCN: I did get a "Rejection Notice" for my evidence, but 45 days later I am yet to get a "Charge Certificate"

So I either have a Rejection Notice and no Charge Certificate, or no Rejection Notice and Charge Certificates.

Is this correct procedure in both instances? I can't appeal to a tribunal without a Rejection Notice, but they skipped straight to Charge Certificate.

@selfstartr you don't necessarily need a notice of rejection in order to appeal, but we do need to work out what's happened.

Please read the instructions here and then post up all the documents you have received, redacting only your name and address.

Given the number of PCNs you have, the best way to do this is to make a folder on google drive or dropbox,  make a sub-folder for each PCN, and then post all the documents for each PCN into the respective sub-folder.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.
