Newham - 52m - prohibition on certain types of vehicles

Hi all,

My mum recieved a Penalty Charge Notice (PCN) for failing to comply with a prohibition on certain types of vehicles (52m) in the London Borough of Newham. I have attached a link to the video feed, images of the alleged contravention and a copy of the PCN. My mum said that she does not recall seeing any warning signs prior to making the left turn.

Any advice on this? Are there any grounds for appeal here?

Do you know the name of the road that Mum was turning from? I'm not sure there is a GSV view that might show any advance warning signs on the approach.

Unfortunately the Browning Road bridge restriction is one of the largest revenue generators in the country, so I don't expect much enthusiasm to cancel from Newham. You'll have to fight all the way to the Adjudicator.

That said, in most cases, it's worth trying a representation against the PCN when you're within the discount window as Newham usually re-offer the discount if they refuse. So it's risk-free.

Looks like she turned left from Rectory Road, you can see the railings in this GSV view of April 2019. However, until we know what the current signs arrangement is we are in the dark.

However, the council are under a duty in Regulation 18 of LATOR, to place adequate signage to advise motorists of restrictions. SO have they now done so, because it was totally inadequate before.

Thank for your replies.
I will head down to the location to get some new photos.  I'm away for a few days,  so will do so before the end of the week.

I visited the site and have taken some photos to assist with the representations. Any advice with this?

This is the route she would have taken.

1. Travelling on Chesterford road to the Rectory road junction
2. Turning left into Rectory road
3. Turning left into Browning road




I recorded a video (below link) whilst driving to give you a better idea of the route. Note, for obvious reasons, i parked up on the right hand side of rectory road before reaching the browning road junction.

I believe i have until tomorrow to submit representations to make the 14 day discount. Apologies for the short notice, but my son and I have been in hospital all week for his treatment so couldn't upload these any sooner.

Looking at the photo, and also your video, it is clear that Newham have finally done something, and put up an advance warning sign, and in the form we like to see on this forum. Your video shows this very clearly, so it basically destroys any reps you might submit based on a left turn into the restriction.  Sorry to have to be the bearer of bad news.

Thanks for the feedback.
Is it best that i ask her to pay the penalty in that case? I believe i have to pay by midnight to catch the discount period.
