Hi all, I'm appealing a PCN I received for entering a restricted zone just 8 seconds before the end of the restriction period. I'm a doctor coming off a night shift and was taking a new route. I didn't notice the sign, and my car clock showed 09:15, which led me to believe the restriction had already ended. The council’s footage shows I entered at 09:14:52. I'm arguing that this is a de minimis breach and that it's unreasonable to expect drivers to have clocks synced to the exact second.

Please can you advice and has anyone had success with similar appeals?

If you didn't notice the sign how did you know it had ended?

What is the PCN number and car VRM so we can check this properly.

But this ought to succeed on de minimus - we've had a few case like this recently and if Ealing is unreasonable adjudicators will usually be sympathetic to timings less than 1 minute.

i didn't see the sign intially, but later one of the drivers on the other side pointed it out and looked at my dashboard.


So this is indeed just a few seconds. I see what you mean about being alerted - by another driver but too late as you'd passed the sign.

You can't tell an untruth that you were aware of the restriction and consulted your clock beforehand. But you can word a representation that is neutral:

I passed the sign just about 7 seconds before the end of the restricted time which is a trivial margin of error.

A decent adjudicator should allow it anyway should Ealing reject as some of them don't have faith in the accuracy of council clocks.

Deear Council,

I am writing to formally appeal the issuance of PCN []for an alleged contravention of entering a restricted zone shortly before the end of the prohibition period.

I am a doctor and had just completed a night shift on the day in question. I was driving along an unfamiliar route and, regrettably, did not see the restriction sign in time. I genuinely believed that I was entering the zone after the restriction had ended. My car’s dashboard clock displayed 09:15, and I relied on that time in good faith while driving.

According to the council's evidence, my vehicle passed the signage at 09:14:52—just 8 seconds before the restriction ended. While I appreciate that the council’s system is highly accurate, it is not reasonable to expect all drivers’ clocks to be synchronised to the exact second. Most motorists rely on standard car clocks or personal watches, which can naturally vary by a small margin.

Given the negligible nature of this discrepancy and the fact that I acted in good faith, I respectfully ask for this PCN to be reviewed and cancelled on the grounds of proportionality and common sense. This is clearly a de minimis situation where a few seconds made the difference, and enforcing a penalty under these circumstances would seem unduly harsh.

This bit isn't true though and you should delete it.

Sorry, I just read your comment. my family has emailed the letter on my behalf as I was at work. Is there any chance to resend them ?

Ealing money-grubbing again ! As Mr Mustard says, they are shameless. Thoughts of the Mikado come to mind when I see stuff like this - "Mikado - Yes. Something lingering, with boiling oil in it, I fancy. Something of that sort. I think boiling oil occurs in it, but I'm not sure. I know it's something humorous, but lingering, with either boiling oil or melted lead. Come, come, don't fret — I'm not a bit angry."

Well you can see that paragraph is contradictory and partly untrue. I wouldn't worry - post what they reply with. It's a PCN not a bank robbery.

And don't rush things. It's frustrating for us when we try and help and people go off half-cocked.
