Newcastle City Council Issued me with a farcical PCN in early November 2025 and to be fair I just ignored it, I so wish I could get a judge to look at the video as it is so pathetic, I intially thought I made a mistake in Newcastle city center driving as it is a nightmare and designed to make you fail - but it was not - my problem is I completely ignored the letters and it is now with the Bailiffs and my research indicates that there is literally nothing that can be done now which is sad as like Croydon council - Newcastle are trying to use the motorist to fill the void in the budget overspend with outrageous PCN claims - I cant use the T7 form as I dont meent any of the criteria, so unless anyone knows a potential way round this, it looks like I will have to pay these criminals £190.00 - I did contemplate letting the bailifs keep coming out and telling them to f-off and hope the council then try to get a CCJ which would then hopefully give me the ability to show the court the video one concern i have regarding this is that I own my flat outright and dont want them to put a lean on the property

and begin by posting up here all sides of the latest 'letter' from Newcastle.

Only redact yur name & address from documents - leave all else in.

£190 now, then another £235 if they have to visit. As regards your suggested plan, this would work out as an additional debt of approx. £33 per letter.

These Regulations make provision for recovery of fees and disbursements from debtors by enforcement agents in relation to the procedure for taking control of goods under Schedule 12 to the Tribunal...

The matter has already been reviewed by a court, the Traffic Enforcement Centre who authorised the warrant of control.

IMO, your best bet is to see if the £75 Enforcement fee, which was added when the Notice of Enforcement was issued, could be saved. We need to see the Notice of Enforcement.

Just to add that a CCJ is not possible under the legislation. Do also be aware that bailiffs can seize goods standing on the public highway. Essentially, this means your car, which they can sell to get the money.

I have enclosed images of the latest letter ( front & back ) from the Bailiffs, and video of the exact incident that the PCN was issued, as previously mentioned I assumed it was from a mistake I had made in Newcastle town centre, but upon viewing the video it was actually on the ourtskirts of Newcastle, I recall the incident and my vehicle made an almighty bang noise and lots of warning lights came on the dashboard and my immediate reaction was to pull to the side of the road ( as can be seen by my severe swerve to exit the main road ) as soon as I stopped the warning ligths went off and I drove back on to the main road appox 13-15 seconds later as can be seen in the video - when I called Newcastle City Council ( I had not viewd the video at this point ) she was watching it and said ohh yes you pulled right outside of a school, but the incident was at 19:40 pm so am not sure how this is even relevant - a terrible council to deal with, they said I can only use the Te7 Form but it is completely pointless as I do not meet any of the strict criteria - I am prepaired to fight this if I have a good chance of stopping this council stealing money from motorists who did nothing wronng so your opinions are very much welcomed.

You need to pay it today -as their letter indicates, if not paid in time, the amount will only increase.
Check online to see if they will accept £190, or if another amount is showing and come back here to let us know the outcome.
Paying the amount due today will stop further increases.

I can not bring myself to pay £190 for a completely farciacal PCN - I am not concerned regarding the bailiffs visiting my property, but could someone advise on weather I would have a good chance considering the stated facts/video that if the debt was returned to the council as unrecoverable ( which I would make sure the debt was ) and they decidedd to take me to court hat I would have a good chance of the judge kickeing this farce out after watching the video.

As far as I can see (others will correct me if I'm wrong) it has been to court and you decided not to challenge it. You could have
made reps against the PCN;
if rejected, appeal to the tribunal;
challenged the charge certificate.

You didn't do anyof these, so the TEC granted an Order for Recovery to Newcastle, who instructed the Bailiffs to collect the debt.
At every stage hereonin, Jacobs will add fees and expenses, and eventually seize whatever they can of your property to settle the inflated debt. There will be no appearance before a judge to see the video.

Why would 'the judge' watch the video? You were given a window of opportunity to challenge the PCN and by not doing so you've already admitted defeat.

You can get it reset if you never received the original PCN but you've confirmed that you did.

If the PCN didn't inform you of the time limits then that might be something we could help you challenge?

They have been to court and effectively obtained a default judgment because you forfeited your opportunity to represent your case by failing to engage with the council in a regulated manner.

You can try whatever extra-procedural tactics you wish to bring this to the council's attention. But IMO, I don't see that we could advise because we focus on intra-procedural advice. Perhaps bailiffadviceonline might help you.

But the deadline to pay at the lower rate has passed, hence the advice above to pay. After this you could engage formally with the council and see whether they'd consider looking at the PCN.

Hi each and all - I have just spoken to a very knowledgeable lady at Bailiff Advice Online who advised that the TE7 would not be accepted by the council, my options are to pay THE £190 but they will already claim to already have been and the price will have increased, or if I am not concerned about the bailiffs coming to simply ignore and the debt return to the council unrecoverable as the Bailiffs are pretty much the last thing the council can do, they will simply end up writing the debt off, they can not put a lean on my property or get a CCJ in relation to the debt

It's unrealistic to expect to be able to ignore bailiffs with no consequences.

If you do not pay the bailiffs will be able to take your properly to settle the debt, probably starting by taking your car and auctioning it off.

With all due respect this lady has been doing this kind of thing for 24 years so I am inclined to bow to her knowledge and experience, they cant take my car as it is soley a delivery vehicle which can be proved, and the order from the court only lasts 12 monsts upon where it has to be returned to the council

AND I QUOTE

"It is highly unlikely that a local council will get a County Court Judgment (CCJ) for an unpaid Penalty Charge Notice (PCN). Council-issued PCNs are generally enforced through a different legal process—the Traffic Enforcement Centre (TEC)—rather than the County Court system used for CCJs"

"in the vast majority of cases, a local council must obtain a County Court Judgment (CCJ) against you before they can apply for a charging order (often referred to as a lien or legal charge) on your property"


Lastly the the Traffic Enforcement Centre (TEC) IS NOT A COURT OF RECORD so in essence should NOT EXERCISE ANY POWERS OF A COURT OR RECORD - or EXCERSISE ANY JURISTICTION UNDER THE SUMMARY JURISTICTION


I haved decided to fight this corrupt council all the way starting with a DSAR first thing on Tuesday morning, I will keep everyone updated as to path it takes including any Bailiff interactions as this sittuation will surely help somone else out there who will face similar circumstances.

This is an everyday situation - if the bailiff visits they add £235 and can clamp your vehicle.
