Hi all - firstly many thanks for your help over the years - have won many private PCNs and one council PCN where they were doing works and signage was poor.

Now on Angel street manchester, where there are 2 e chargers in 2 of the bays, Ive displayed a disabled badge while charging (as ive done many times before).

Ive come back to a PCN, my worry is that the badge may have expired - however i dont display the full details - so its usually fine. Im assuming the warden hasn't seen it perhaps? as its always been fine before. I know council ones are more difficult to contend. Advice please.

Its a joke that an already expensive EV charger (which states free on the BEV app) requires car park charges too.

Sorry, but we need to see the PCN and also look at a GSV view to see what is there, assuming GSV is sufficiently up-to-date.
As I understand it, a BB doesn't guarantee free parking no matter where you park.

BB is free parking anywhere - paid for, single yellow or double yellow for 3 hours ive always understood?

I cant find the option as per the guide to embed an image of my windscreen

Only you know. Was the BB valid on the day in question?

No it's not. Bays reserved to specific users, as here, being a case in point unless the council's traffic order has included such an exemption. See your BB booklet as per Incandescent's post above.

The BB basically negates paying for a bay - i actually think it says this at the pay and display so I will take a pic of this today!

IMO, No it doesn't as a matter of statute, but whether a local authority has chosen to do so, we wouldn't know.

In any event, your BB was not displayed in the prescribed manner because the year was not visible, therefore in the CEO's mind there is NO evidence of the display of a valid BB and consequently whatever exemption might have been afforded by virtu if its display did not apply.

What is/was the expiry date of the BB?

We should check their photos and look at the location, pl therefore post a GSV link and your VRM.

The thread title is - EV charging bay.....
..but the PCN was issued for non-payment.

This could apply only if it was a shared use bay, but we should see their photos and your link to confirm it's even an applicable contravention.

Free parking for BB. So he's either missed it or basing it on not seeing the date. That also talks about resident parking which im unaware of as this is on my street

Any BB exemptions are predicated on the badge being displayed as required and valid. Yours wasn't as regards display and you've not told us its expiry date.

We must have a location and their photos, we can access the latter online but only with your VRM(which is on display 24/7) and the PCN number, which we have.

Ie. To charge in the bays (despite BEV app clearly stating parking is free, you must presumably buy a ticket to park as with the non EV bays) my point was that it states BB are free to park in any bay but also it references residents parking which i wasnt aware of (and am a resident so could maybe look at a permit if thats even a thing there)

I can't see much mileage in debating whether a BB displayed properly gives exemption from the payment requirement of this multi-layered restriction until you've shown that you have a valid BB and can construct a compelling 'terribly sorry, thought I'd displayed it correctly but can see that I hadn't, mea culpa, please excuse me here's a copy of my valid BB' argument.

Also, are you the registered keeper with current DVLA details? I ask because any NTO would be sent to the RK and if a hire or lease company then further complications follow.

If your company owns the vehicle, as opposed to, say, you being its primary user on behalf of the company but the vehicle itself is leased, then on receipt of a NTO addressed to the company you could authorise yourself to make reps on behalf of the company, which I assume would be to the effect that on the day in question the vehicle was being driven by *** who holds a valid BB which they thought was displayed correctly, thereby exempting them from the requirement to pay, but can see from the evidence that it was not. This was a genuine mistake, here's a copy of the BB in question which is held by **** who you believe made representations earlier on the same compelling grounds.

But a copy of a valid BB would have to be presented IMO.

Others may have different views, so pl wait before acting. The 14-day period for making risk-free reps ends on 9 July.

Manchester allows unlimited free BB parking in parking bays so presumably this includes this 3 hour EV pay pay but one wonders if that also includes non-charging. The clock is presumably not needed.

The partially obscured BB is almost certainly the reason for issuing the contravention of parking without displaying a valid pay and display ticket (the PCN is only still a £50 PCN, £25 at discount).

This is a pain in the system. There are no codes for incorrectly displayed badge or clock not displayed. So if you incorrectly display your blue badge, or fail to show the clock when its needed, or try and get extra time by nudging the clock on you get whatever contravention it would have been had you not displayed the badge at all, and people get most confused about this.
