BUS LANE PCN - NEWINGTON BUTTS

PCN for being in a bus lane that is in NEWINGTON BUTTS SE1 | North-eastbound to Dante Rd on 19 November at 05:25AM. Notice served on 24 November. The VRM is LT08 XEL.

Hello, and thank you for the advice you provide.

I recall driving to my work office on the aforementioned day and time.

However, I do not recall driving in a bus lane. The evidence provided consists of a dark, low-quality image showing only my number plate and a second image of a blurred vehicle in a bus lane, which cannot be reliably identified as my car. Additionally, the two images were taken one second apart, which suggests the possibility that, if I briefly entered the bus lane, I may have moved back into the correct lane almost immediately.

The notice letter states in its FAQs that reconsideration may be granted if a valid reason is provided for being in the bus lane for a very short period. However, if I did enter the bus lane, it was entirely unintentional. I did not realise it at the time, as I normally pay close attention to road markings and lane usage, and I am unsure whether this explanation would meet the threshold for a valid reason.

Please tell us your approach street to Newington Butts. We need to look at the signs for adequacy. All the PCN photos are taken from a video, which is their sole evidence. If you take them to London Tribunals this will be viewed by the adjudicator.

- Keep right to continue on Kennington Park Rd/A3
- Keep left to stay on New Kent Rd/A201 [THIS IS WHERE ALLEGEDLY I DROVE ON THE BUS LANE. JUST BEFORE THE ROUNDABOUT]
- At the roundabout, take the 2nd exit onto Tower Bridge Rd/A100

You n eed to phone TfL and ask them to place the PCN on hold whilst they send the video (DVD) out to you.

If you came along Kennington Park Road, there is an advance buslane sign at the traffic lights : -

then there is the buslane sign at the start of the bus lane.
So signage seems adequate to me.

Having said the above, there is a getout that Hippocrates has identified whereby at the adjudicators the appellant can demand the attendance of the enforcement authority, in this case TfL, but I'm not sure if this is the Act TfL are using, (see top of your PCN). In most cases the authority never turn up so you win by default.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
