“Thank you for writing to us and enclosing supporting evidence.
We have carefully considered what you say but we have decided not to cancel your Penalty Charge Notice (PCN).
You were issued a PCN for not having a Pay & Display ticket that was both valid and clearly displayed. Even if you have a Pay & Display ticket, you have to display it so that a Civil Enforcement Officer (CEO) can see all its details. You were also able to pay to park by phone or online; however, the CEO's handheld computer showed no valid period bought by phone or online.
I note you refer to the 1-hour free parking at the location in question and I must advise that to qualify for the 1-hour free parking, you have to register your parking time on Pay by Phone.
All instructions are explained on the signage in the car park and the responsibility remains with the motorists to ensure they make themselves aware these in order to ensure their vehicle is correctly parked.
If you are unable to register your parking on the application, you also have the option of contacting Pay by Phone via a telephone.
In circumstances when you are unable to validate your arrival time to the car park, alternative parking arrangements must be sought in order to avoid incurring a PCN.
There are no justifiable grounds for a cancellation of this PCN to apply in your case. The council are satisfied that your Notice has been correctly issued and remains enforceable.”
