Letter of Enforcement received, no PCN letter received.

Hello All,

I am new to this and not seen any posts on this.

I have received a notice of enforcement letter for a warrant of control - PCN, which I have not received the original PCN notice/letter.  This was for driving in a bus lane in September 2023.  This for a vehicle that I no longer have.

I usually receive PCNs at my current address where I have lived for 5 years.

I would be grateful for any advice?

Please post all sides of the 'letter', redacting only yr name & address - leave all else in.

Who are 'Onesource (RDL)'?

Do you know which authority issued a PCN?

Hi John,

I am not sure who Onesource are as I think it is the third party company for PCNs.

I do not know which authority issued the PCN as I never received the original letter.

It's a bus lane in Havering.

Can you recall what address this car was registered to at the time as you didn't receive four letters at least.

OP, you need to give us the facts pl:

This was for driving in a bus lane in September 2023.

These statements could only be intended to inform us that the vehicle's RK was you and that as your vehicles have for the past 5 years i.e. since before this event, always been registered to 'this address' then it follows that the authority have wrongly addressed at least 4 notices.

And then this bombshell:
It could be possible that it was registered to my old address which I can remember.

How could it, the event only occurred 2 years ago.

Regardless of the almost certain failure by the OP to update the V5C for his car, (and very difficult to now check as the vehicle has been sold); as the debt is at enforcement stage with the bailiff fee at £75, payment is probably the best option to avoid the £235 visit fee.

Of course if the OP is much more forthcoming, a credible submission of an Out-of-Time Statautory Declaration could be developed here or by bailiffadviceonline.

Please confirm that it is your name and current address on the Notice of Enforcement from Rundles?
When did the Notice arrive with you?

As I understand it, oneSource is a privately owned limited company wholly owned by the London Boroughs of Newham and Havering. The company provides a number of services into the Councils, including debt recovery. I further understand that they employ their own enforcement agents who are presumably certificated. Or maybe they don't anymore.

I would have expected that the Notice of Enforcement would have been issued by oneSource. Instead it looks like oneSource have sub-contracted the enforcement to Rundles. I have my doubts as to how that can be legal.

The warrant is a Local Authority Warrant of Control. Authorisation for a warrant can only be requested from the TEC by the Enforcement Authority, in this case LB Havering. The TEC authorises the warrant and the EA can then issue the warrant to the bailiffs/enforcement agents to enforce. That should mean oneSource. So any Notice of Enforcement to you should have come from oneSource. The underlying debt cannot be owing to oneSource as stated on the NoE, only the statutory enforcement fees. The underlying debt is owing to LB Havering and the NoE should make that clear. However since the enforcement fees, currently £75, are owing to Rundles then nothing can be owed to oneSource. The NoE seems to be seriously defective.

I suggest that you contact the Traffic Enforcement Centre helpdesk at Northampton County Court first thing on Monday.
Confirm that the address on the warrant issued 03/09/2024 was your old address?
And whether or not the warrant has been re-issued (re-sealed) with you correct and current address?

I further suggest that you seek advice from Bailiff Advice Online as to whether the Notice of Enforcement from Rundles is enforceable. As well as the possibility of an Out of Time Statutory Declaration.

You have a few days to investigate as the deadline is 6.00am on the 18th August. So if you need to pay the NoE make sure you don't miss the deadline.

Can we please have an update?
Have you contacted Bailiff Advice Online? What did they say?
Have you contacted the Traffic Enforcement Centre?
And have you paid the Notice of Enforcement

Thank you everyone for your help and advice. I have gone ahead and paid it.
