Leicester City Council

Hi everyone,

I received a charge certificate from the above council back in September (Attached). In all honesty I havent had time to deal with it as am a full time carer for my daughter. I have now received a Order for recover of unpaid penalty charge (Attached).

The charge relates to a parking ticket in Leicester London Road, and has my car details back in June 2024. ( I have not seen photos of this charge showing my car reg)

I can confirm I did not visit Leicester or park on that road and its not my car.

I think there was someone driving around with my number plate as I also received a police speeding ticket from the Leicester region which I have challenged.
On that speeding ticket photo the registration of the car was spaced differently to how it is spaced on my car, although it had the same characters.

What should i do?

Any help would be appreciated.

The PCN was served for a parking contravention, so I assume you didn't find one on your car.  Next statutory document would be the Notice to Owner, which again you don't mention. So the question is, is the name and address on the Charge Certificate and on the Order for Recovery correct in all details ?

Anyway, having received the Order for Recovery, the third and final statutory document, it should also have included the form to submit a Witness Statement. Was this form included ?  Even if it wasn't, you can download it from the Traffic Enforcement Centre website (see below).

Just to add.....
Obviously, if your car number plate has been cloned, you would not have received a PCN for a parking contravention, it would have been put on the criminal's car.

Important point is that in order to submit reps that explain the cloning, you have to get back to the PCN stage, hence the submission of a Witness Statement. Puzzling why the Notice to Owner wasn't received.

Some advice - never ignore things like Charge Certificates or any PCN for that matter, because if you do it will come back to bite you as you could lose all appeal options.

I have never received a PCN as I have not travelled to Leicester for over 10 years.

I did not receive a Notice to Owner, I have only received the two attached Docs, and I received a Pre Debt registration letter. In the that pre debt letter it said I had received the notice to owner, but I never did. (I keep all correspondences)

The name and address on the Charge Certificate and on the Order for Recovery are both correct

I did not receive a Witness Statement in the order. (I will download it now)

As for the numberplate, the person has mis arranged the letters of the plate. But given there is only one plate like that I have received the penalty.

i.e my plate is similar to this…..WEZ 5815 and is spaced as written.

The speeding penalty I have received from the police showed it as follows WEZ5 815, which was the basis of my appeal. I had to show photos of my car etc to prove. Is there a way I can get photos from Leicester council or do they not take them on PCN’s?

Just to clarify…. I am to download the witness statement and keep the basis of my argument to question why I have not received a Notice to Owner? Is there anything else I should say or do?

There's a web address for Leicester parking services on the second page you posted - usually if you go there you can view the docs and pictures associated with the PCN.

All you have to do is fill in the Witness Statement, ticking the box for "I did not receive the PCN", sign, date and send off.

Please note that the "Applicant" is Leicester City Council, (see the box top-right of the form), not you. TEC will cancel the OfR and CC, and inform the council. You should then get a PCN which you can then pay or submit reps against. The enforcement process then restarts and you can take them to the adjudicators if they don't back down.

Don't delay sending off the WS; the OfR gives a date for payment and that is also the deadline for submission of a WS, (date TEC need to receive it, not you send it off). As I understand it, TEC will accept a photo of the completed form by email.

Many thanks for your help. I have filled out witness statement and sent it over to TEC.
