Hello,

Parked in the parking bays on the side of 'Pizza Point' (GSV below) and in haste forgot to Pay by Phone. Narrowly avoided the car from being 'lifted' after darting out of nearby shop once being made aware that there was a vehicle about to be lifted by a local shopkeeper. Sprinted to said bay and asked 'Why are you lifting me'..

The warden then proceeded to walk around the car and show part of the rear tyre that was out of the bay and on the 'single yellow' - again in haste and rushing around the driver didn't check whether the vehicle was completely in the bay.

Yellow sticker PCN affixed to vehicle - Not sure if this has to be done before its lifted. In any case the contravention is 01 - Parked in a restricted street during prescribed hours. Currently still within the 14 days.

Went to attempt to pay payment - but stopped short and thought lets have a look at the images/video - of which there isn't any that I could spot.. Is the PCN still valid?

Best advise please..

They don't need pictures to enforce parking PCNs and you were lucky to stop them taking the car, but they would have taken pics before doing so.

Waltham Forest is getting a reputation as a tow happy council and this is a minor contravention but they are entitled to issue a PCN for this.

As they don't have pics you could try and get this cancelled by arguing it was trivial but you can't show them your pic.


Ok scrap that - they took 77 pics...

WF's site is very slow - if you keep the evidence window open they will appear.

I'd say you had a lucky escape and should pay the discount but let's check the signage and traffic order first.

Okay - Do you need anything from me in order to do this?

Looks like the line has a proper order and it's in the right place.

We've seen a few predatory tows by WF - there would have been no traffic management purpose in impounding your car for one wheel outside that bay on a side road.



So pay the discounted rate then I guess as the conclusion?

It's what I call a money-grubbing PCN, but with your wheel on the yellow line, it's lawful, I'm afraid. If it had just been the rear of your car over the line, you could claim 'de minimis'. Mind you, having seen a 70s Cadillac Eldorado recently, the rear of the car projected about 4 feet beyond the rear wheels !



One small point which may be moot-

BUT

Should the observation time on the PCN before they issue be a minute or so at least.. it currently reads from 11:27 to 11:27?

Might be a dud point

Observation would be in play if you were loading/unloading or engaged in assisted board/alighting.

There is no legal requirement for a period of observation.
