Hi - Sorry I came late to this website and have already made 2 representations which newham have rejected. the last letter they sent me is attached dated 11 december.

I was parked in a loading bay, loading a fridge into the back of my car, whilst clearing out an office I had rented in the expressway. The Expressway is a collection of small office units for rent and we were moving out. It is built under the flyover of silvertown way, so by its nature is long and narrow. Our unit takes a long time to get to and back as it is right at the end (a lot longer than the 5 minutes my car was observed). I explained this too them twice now and they still persist as they observed no loading during the 5 minute period. Like it would be reasonable to leave my car boot open whilst I spend 15mins collecting the fridge!

I have photo evidence of the fridge being lifted into the car by a couple of colleauges - see below.

Well, obviously you now take them to London Tribunals.

I see they have tempted you away from this course by re-offering the discount. Did you submit the photo of the fridge being loaded into the car as part of your reps ? You certainly need to include this if you go to London Tribunals.

You are going to need to show evidence of the end of tenancy, and where the office was in relation to the car. It is a fallacy of the councils that loading must be observed but loading is just that collect the goods bring them to the car and load not stop to answer the phone or have a cuppa so you will have to explain fully the time taken

Yes I have submitted the photos and I explained the length of the walk to the collect the fridge, I didnt give them the end of the tenancy but I can get that. I will get the layout and submit this too.

Of course it's not 'unbelievable', what would you expect the CEO to do, wait until someone returns to what is after all a locked and unattended vehicle, possibly hours later, or get out their crystal ball and divine where the driver was? I'm not being facetious, just practical. You're falling into the trap of superimposing your knowledge on to the CEO but without any reason to do so.

Is your photo timed?

Where's the PCN and NTO?

Unfortunately, all this could be academic because the NOR is dated 11 Dec. which means that the latest date for statutory registration of an appeal was 9 Jan!

Have you registered an appeal? If not, do it now. Grounds: I rely upon my formal representations. Only worry about substance when you've successfully registered.

They are asking a reason for late appeal.

Is there a good generic/standard reason that they might accept?

It was over xmas holidays, I was away for xmas seeing family is the truth!

The time on the first of the photos is 12:34.

I cant find the original PCN sorry.

Forget these distractions pl.

When you went online to ETA you were advised that

If you miss the 28 time limit your appeal may still be registered by the adjudicator.  When you submit your appeal you must include an explanation for the delay. The adjudicator will then decide whether the appeal should be registered.

No, there isn't a generic form because lateness requires reasons which will differ from case to case.

The NOR is dated 11 Dec. and would be presumed served on 13th. I cannot tell you what to write, but whatever you submit you should be prepared explain in detail should you be asked. There is an expectation that 28 days is more than enough time. However, some posters here have experienced postal delays and, as you say, the Christmas and New Year intervened.

Don't think about this, get it done ASP and keep your fingers crossed.
