Lambeth PCN - Contravention 19s
« on: »
Hi there, my missus received this parking ticket when taking our daughter to Kings College hospital.  She had paid to park but because of lack of reception she wasn't able to add to the booking via the app, and couldn't leave our daughter in the hospital.  Please can I get some advice on appealing this ticket as its quite harsh in the circumstances.

Thanks

@Aubama give us the PCN number and the number plate please.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

So that's all quite jumbled up but this is what I think you mean: She paid to park initially and went to the hospital with your daughter, then while in the hospital the parking was going to expire so she tried extending it but there was no reception.

Is that what happened?

If so, can we see screenshots of the original parking session please?

Also, why was your daughter in hospital? There might be some worthwhile mitigation to look at.

Thanks for your response, yes thats exactly what I meant.  Also the hospital appointment was running behind schedule.

The orginal payment is here:

Our daughter was in hospital at the Otherpedic & Trauma department for a scheduled appointment at 3pm.

Here is a draft representation to lay the groundword:

Dear London Borough of Lambeth,

On the day of the alleged contravention I was accompanying my daughter to Kings College hospital, I was taking her to the Orthopedic & Trauma department for a scheduled appointment at 3pm. I duly paid for my parking session but as matters were taking longer than expected, attempted to extend the parking session but I had no reception. I was not in a position to leave my daughter unattended and despite repeated attempts, I was not able to extend the parkin session.

I hope that in light of these mitigating circumstances you will agree to cancel the penalty charge.

Yours faithfully,

Do not supply any supporting evidence at this time, we want to keep that for the notice to owner stage.
