I make representations on the ground that the alleged contravention did not occur.
The CCTV shows that my vehicle (registration FV71 RVN) was the third vehicle in a sequence already proceeding into the narrowed section of carriageway. Two vehicles ahead had already committed to the manoeuvre. By the time my vehicle followed, it was not reasonably possible to stop or reverse safely without causing obstruction.
Priority at this location is conveyed by signage for each direction of travel. The CCTV does not demonstrate that, at the point my vehicle became committed, the oncoming vehicle had reached and was exercising its priority in a manner that allowed a safe opportunity for my vehicle to yield. My vehicle was already substantially clearing the narrowed section by the time the oncoming vehicle reached the point at which priority would be relied upon.
Although the oncoming silver vehicle appears to pause briefly, the footage does not establish that this pause was forced by my vehicle or that it amounted to a material impediment. The oncoming vehicle proceeds without emergency braking and without being required to wait for my vehicle to fully clear the restriction. Any brief hesitation appears consistent with anticipatory caution in a narrow carriageway rather than enforced priority.
The CCTV does not demonstrate a realistic decision point at which my vehicle could have safely given way once traffic ahead had already committed vehicles into the narrowing. In these circumstances, the authority has not discharged its burden of proving that a failure to give way occurred.
Additionally, I note that the information provided to the motorist regarding time limits is unclear and inconsistent. While the Penalty Charge Notice refers to periods calculated from the date of the notice and the date of service in different sections, the council’s online portal states that the penalty charge will increase on 23 January 2026 and continues to show that representations remain available.
A motorist is entitled to clear and consistent information as to their obligations and applicable time limits. I relied on the council’s published online information when making these representations. Any ambiguity created by conflicting guidance must be resolved in favour of the motorist.
For the above reasons, I respectfully request that the Penalty Charge Notice be cancelled."
