Author Topic: Lambeth council, contravention 38 I, passing wrong side of sign, Kings Avenue (E)  (Read 118 times)

First time poster, hopefully I've followed the instructions!

I've received the above 38 I PCN in King's Avenue, Clapham, London.

The images show me on my moped slowly approaching a traffic island with a 'Go left' arrow in heavy traffic and looking like I will go round it on the wrong side. The video however is inconclusive and does not clearly show the offence. There is a big red 137 bus obscuring the view of the camera at the actual point they state I may have gone around the traffic island. It would have been possible for me to have been filtering around a Lexus before the island, then cutting in to stay on the correct side. The camera then zooms in once the car blocking my path has moved and shows the island and sign, but I am not in the shot.

Does anybody think I have a case to challenge this? Thank you kindly in advance.

The video is their sole evidence of the alleged contravention, so if it doesn't show you passing to the wrong side of the sign, then the PCN cannot be enforced. They are not allowed to gues what happened. Your link to the video doesn't seem to work, but if you unredact your reg number we can go and look ourselves.

Pictures show GX68END - but portal says it is paid, so end of the line anyway!

An interesting case study however - the bus blocks the view of the sign, but the video holds the view after the the moped passes until the bus moves and the sign is revealed.  So the vid doesn't show the moment of offence, but it is clear that it did happen - a lottery at the adjudicator?

Unfortunately I was only passed this PCN from my ex yesterday and I realised I was right up against the deadline for the reduced rate (14 days from 19th Jan = 2nd Feb), so I've taken the £80 hit rather than gambling on an appeal.If I'd have had even one extra day I'd have waited for a few more replies first.

I think I agree with you RichardW - the video suggests the offence may have taken place even if the video doesn't directly show it. I will reluctantly chalk this one up to experience.
