So the driver of the vehicle stopped at a bus stop to drop off a disabled passenger and carer for a gig in at a local venue, only safe place avaliable was bus stop, vehicle is a motability car with blue badge registered to the driver, can it be contested?

Any PCN can be contested, the issue is - will the representations be accepted or not ? And if not, would an appeal to London Tribunals succeed or not.

However you should be aware that restricted bus-stops have no exemptions for BB holders.

Hi well, it's the Royal Borough of Kingston upon Thames.
Pcn reads, 47j stopped on restricted bus stop or stand (camera enforcement)
Still at the first notice stage.
So the driver of the vehicle dropped off his disabled partner for them to attend a gig at a local venue.
They had circled the area numerous times trying to find a safe and convenient location as his partner has limited mobility and everywhere else was unsafe .
The driver is unfamiliar with the area being from the north East.
Is it worth trying to contest the Pcn or not?

We always recommend PCNs be contested at least once, at the informal stage; just coughing-up is joining the Mugged Club. Your reps would come under 'mitigation'. But if you want further help, please post the required documents as per the link I posted.

There is no 'first' notice as such, which implies a second. This is the only notice. If the 'buses only' sign was in situ, then IMO all you have is mitigation. Occasionally defences emerge based on technical arguments e.g. lack of visible and correct signage(having regard to the length of the bay) etc. You should at least post the video or alternatively the PCN number and VRM so we can access.

I'll take a look later at the stop today. RBK have a major issue with their paperwork at present. So, yes, I would make formal representations. Did you not see any upright sign or even look for one? I guess not from watching the video.

If I'm honest I didn't see any signs, and had both passengers shrieking about getting to the venue in time and being able to walk the distance, having circled the area several times looking for anywhere to stop safely so was more than a little stressed

The council can use discretion and should do if you can provide solid evidence of disability and access issues.

But the contravention is there. It looks like there were yellow lines just before the stop you could have alighted from.

This is Hippo territory so he may have something.


I agree with @stamfordman. I will head out there nowish and have a look at the upright sign to see if it complies. The car stopped right by it though!

Did you not know that you can alight passengers on single or double yellow lines ? There seem to be some either side of the bus stop.

I do but I was overly stressed, and had been carved up a few times going round the block felt unsafe trying to stop there.

The upright sign is as faded as ever. I will carefully draft something later tonight.

The only place to pull in is Nipper Alley, just before the Spoons. There used to be an iconic photograph of a Spy Camera Car parked there some few years ago.
