Hello,

Would love to see if someone could help with a PCN from Islington Council, Code 21 - parking in a suspended bay.

I parked my car about a month ago and haven't moved it since. The parking bay is next to my house so whenever I leave the house I have good visibility of the signage and I tend to keep an eye on the parking bay to make sure I don't miss a bay suspension. That's why I find it really strange that I missed the sign this - it almost makes me think they put it up very recently and immediately started ticketing.

What's the best angle of attack here? Requesting any evidence from Islington Council that the sign was put up in time? Would the fact that the parking warden observed my car for 2 mins only (based on the timestamps on the pictures) be of any relevance?

First question that comes to mind is, was the suspension sign put up on the sign you observe on a daily basis ?
Second question is, on the day you saw the PCN on you car, when was the last time you had looked at the sign ?

Suspension was for Wednesday 23rd July, for a house removal, so one would expect the sign to be put up on the Friday of the previous week, as it is not an emergency suspension. Putting it up on a Monday is a bit too late, IMHO. as that gives only 2 days notice.

I did leave the house on Monday, Tuesday and Wednesday but didn't notice any signs. It is not inconceivable I missed it however I find it hard to believe as it's well in my line of sight regardless of the way I'm coming from.

As per the islington council website "Advance Warning Notices will be at the location requested where possible 10 days before the suspension starts, but we cannot guarantee the area will be kept clear." (available here: https://www.islington.gov.uk/parking/parking-permits/suspend-a-parking-bay/suspension-of-parking-bay-terms-and-conditions). Is it reasonable to assume the sign should have been up 10 days prior to the 23rd and Islington Council should have evidence of that?

A regular check every other day or so is vital in London and it seems you would have seen a sign right by your car.

They will have a log of vehicles in the bay when the sign went up and yours was presumably so this is often a solid ground for challenge depending on timings.

TIMELINE:

23 July - PCN issued

6 August - informal challenge submitted (online)

12 September - informal challenge reject (email)

13 October - Notice to Owner issued (post)

9 November - formal representations submitted (online)

4 January - 56 day limit for Islington to respond elapsed

6 January - Charge certificate dated 5 January received (post)


I did not receive a Notice of Rejection and couldn't find anywhere whether a NoR is supposed to come in the post or by email - I've been checking both pretty regularly, particularly the last couple of weeks, knowing the deadline was coming close.

A quick google search tells me to wait for the next letter - an Order for Recovery and make a witness statement which will reset the PCN. My position is that Islington failed to respond within 56 days, missed the deadline (not inconceivable over Xmas) and therefore the PCN should be cancelled. Would that be valid?

If the rejection went missing you don't know when it was sent.

So the correct procedure is to go through the witness statement process but make sure you check with TEC to ensure you don't miss the order for recovery - say 2 weeks after the charge certificate deadline and then on.

Is the address on the letters completely correct.

The address is completely correct. Notice to Owner received no problem.

Will keep an eye out for the order for recovery. Can I request a copy of the NoR from the council?
