Author Topic: Islington, Code 21, parking in a suspended bay, Bath Street EC1  (Read 505 times)

I took my elderly father to Moorfields Eye Hospital and parked in a parking bay that has the "suspended parking" yellow sign up but with no start or end date. It was just a blank white paper (see images)

I paid for the parking as normal via the RINGO parking app at 1:57pm but when I came back after the alloted 2 hours I found a PCN attached to my windscreen and somone in the meantime had updated the sign to include the start and end date of the suspension.

My question is whether a suspension is in force if there is no start and end date/time? Have they got me bang to rights? Is there any point in me even appealing?

This is VERY sharp practice by Islington, but typical for London councils, I'm afraid. A good job you took pictures of the sign before and after.

For now, all you need do is submit an informal challenge stating that when you parked there was nothing to indicate the extent and times/dates of the suspension. As there was no information about the suspension the PCN is clearly void and must be cancelled. What should have happened is the suspension details be glued onto the yellow sign, then the sign put up.

Thanks for the advice, yeah I took the pictures because I was worried about this exact issue! But on reflection I wasn't sure whether them just having the yellow sign up means that the bay is disabled regardless of there being no start or end date.

I will submit an appeal online tomorrow and see what they come back with.

Point (a) is clearly mandatory and the sign was not compliant when you parked.

@vampirehb you can't submit an appeal, you can only make an informal representation. Anyway it's really good that you took a pre-emptive photo as that ensures that you basically can't lose. I will however also ask for the suspension logs.

When you submit your representation remember to keep a screenshot of the confirmation page.

Just a quick update to say that I got a reply from Islington council and they have indeed cancelled the PCN  ;D

"Penalty Charge Notice No. IZ30535150 Date of Issue 28/05/2024 at 15:28
Location of Contravention Bath Street [Zone C]

Thank you for contacting us about the above Penalty Charge Notice (PCN).
The PCN was issued because the vehicle was parked wholly or partly in a suspended bay or
space.

I have noted your correspondence and the evidence available, and I can confirm, we are
satisfied that the signage did not have information displayed at the time the vehicle had been
left parked.

This PCN has now been cancelled, you do not need to take any further action and there is
no need to reply to this correspondence.

Please be advised that we consider all cases individually, and so other PCNs issued in
similar circumstances may not be cancelled.
