Islington 34J Being in a bus lane in Clerkenwell Road [Zone C]

Hi all,

I’ve received a PCN 34J for “Being in a bus lane” on Clerkenwell Road (Zone C). From the council’s video, it isn’t very clear, but from what I remember there was heavy traffic with cars queuing to turn right into Farringdon Lane. I continued straight to bypass the queue and didn’t realise I would be crossing into the bus lane.

Has anyone dealt with a similar situation here? Do you think there are any grounds for challenging this, or is it better to just pay the reduced fine?

I only have 3 days left to pay at the discounted rate, so I’d really appreciate any quick advice.

@Tod. PM received. Send us the PCN and VRM details and do not pay anything. The 14 days is just the start of the game. At the end of it, they MUST attend the hearing at the Tribunal OR their evidence is inadmissible. I am here for you throughout the whole process.

Thanks for the reply. What is the strategy here? With my previous PCNs I had to challenge first, then when rejected, take it to the tribunal where the council folded. How are we going to approach it in this case?

BEFORE you make a challenge, pleas screenshot the page and also afterwards as it is far too general.

Challenge: The video does not support the alleged contravention as it shows no upright signs allegedly passed.  plea cancel therefore.

Hi, sorry for the late response — for some reason I wasn’t notified that I’d received your message.I just realised I’d forgotten to click “notify” on this thread, so I didn’t see your message earlier. It should be fine now.

I’ve just received the second letter from the council. Before I make the challenge, I’ll take a screenshot of the page as you advised, both before and after submitting it.

Just to confirm, the wording for the challenge should be:

“The video does not support the alleged contravention as it shows no upright signs allegedly passed. Please cancel therefore.”

Is that correct?

I’ve posted all of the Enforcement Notice as requested, but I haven’t heard back yet. Just wondering what the next step should be — should I go ahead and submit the challenge, or wait for further guidance?
