Hillingdon - Contravention 27. Joel Street, Northwood

Received a PCN for parking near a dropped kerb.
Before parking I ensured that the car was not over the kerb or dropped part - but clearly I was wrong and surprised to receive a ticket.
I checked Hillingdon council website on parking rules near dropped kerbs, as to me eyes seems it could be debated as I believe we are talking centimetres.
Hence, not sure I have any case as have read something about de minimis.
Pictures available on Council website showing their pictures which have been taken at angles so unclear how much it overhangs.
I also took a picture attached below which is near perpendicular to the kerb albeit I could have done better.

Councils usually reject all dropped kerb cases, even when the vehicle is clearly not over the dropped section, some even claiming that the sloping kerbstone is part of the dropped section, which is a straight untruth.

However, here, I think you are slightly intruding into the dropped section by my reckoning about 4" (sorry, I'm old school Imperial here !) or 100mm. So I don't think you have a slam-dunk win at adjudication. Do be aware that virtually all reps on this contravention get a Fob-Off letter, so best if you submit reps stating that the contravention did not occur. No need to tell them much if anything, as they have access to their own photos.

Just send something like: -

Dear Sirs

Re PCN <number> dated <dd/mm/yyyy> served at <location>

I deny responsibility for the above PCN on the grounds that the contravention did not occur. Your own photos will show that this is the case. I therefore request that the PC be cancelled forthwith.

Yours faithfully

Post up their reply when you get it.

IMO you need to submit more detailed reps because you want to tempt them to reject using the wrong legal framework.


Contravention did not occur...

When I parked I checked that I was not in contravention and the authority's photos have confirmed my belief.

I can see that if one takes the sloping kerbstones into account as forming part of the prohibited area then I was clearly in contravention. But as these are not germane then I cannot see any contravention based upon the evidence photos although I accept that the parallax effect can confuse matters, but even so any incursion could only be considered de minimis.

A clever challenge by Mr Anderson and I agree.

Hillingdon is one of the few councils that spells out what the enforcement area is.

Thanks for the very prompt replies.
"stamfordman", I should have attached that picture identifying what Hillingdon' defintion is as I had noticed this, but the earlier posts by "incandescent" and "mickR" (tow bar has been a nuisance on this car) indicating possible inches overhang could be argued by them and was one of my concerns, albeit I would say probably couple of inches.
It really comes down to the angles of the pictures; e.g. the picture from the rear shows nothing, if at all no breach. The ones taken from the side are at best debateable, as it clearly isnt taken at a perpendicular angle and instead slightly to the left ot the right and similarly shows no clear breach, and if best as indicated inches, although not sure about that darn towbar.
My Andersen probably highlights my sentiments and thanks for indicating the terms I should use.
Once again appreciate the feedback and dedication of members replies.
