Merton; Council Enforcement Officer lying about issuing PCN?

Hi all,

Received a notice in the post today about a parking contravention. It occurred towards the end of August and at the time the council enforcement officer told me that it would be sent in the post. Obviously didn't hear of anything and then today in the post I receive a notice asking me to pay the full amount. The notice also states that a PCN was isssued and was fixed to vehicle or handed to the person. None of these occurred, and the photographic evidence from the council doesnt show anything with a PCN either. Not sure how I'm meant to go about this, appealing on grounds of procedural impropriety, but not sure if it's on the council to prove they issued me a notice or for me to prove a lack of.

Please tell us more about the circumstances when the CEO told you the PCN would be sent by post. Did you, for instance, drive off before it could be served ?
