London Councils, Brent, PCN parking grassy verge, no signage
« on: »
Hello,
I received a PCN for parking on a grassy verge on Salmon Street in Brent, close to Fryent Park. I was not breaking the Highway Code but apparently all London councils have an amended version of the Road Traffic Act that prohibits parking on a grassy verge and they do not require signage to highlight this. I have had my informal appeal rejected. I am surprised that there is no legal obligation for signage in the London borough's when there rules are outside the Highway Code. Has anyone had any experience of this? I expect that I am unlikely to successfully appeal. Any advice or similar experiences out there? Thank you!

This is a council PCN so I have moved this post to the Civil penalty charge notices (Councils, TFL and so on) forum.

To help the users there provide you with the best advice, please read the following thread carefully and provide as much of the information it requests as you are able to: READ THIS FIRST - **BEFORE POSTING YOUR CASE!**, This section is for council, TFL, Dart/Mersey/Tyne etc. cases

Footway/verge parking has been banned in London since the 1970s.

But post the PCN with no reactions and we'll have a look.

From the Highway Code:

244
You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking on the pavement can obstruct and seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams or pushchairs.
Law GL(GP)A sect 15

The law is a statute therefore it's not boroughs' rules, in fact the boroughs didn't promote the 1974 legislation, this was the Greater London Council as was.
(S15 refers to parking - https://www.legislation.gov.uk/ukla/1974/24/contents)
