37J - Failing to give way to oncoming vehicles - Lambeth
« on: »
Hi all,
I hope you can assist.

I’ve received the attached PCN, but after reviewing the video evidence, it clearly shows my vehicle passing the oncoming traffic before they approached the narrowing. At no point did I cause any obstruction or interfere with their path.

The still images included in the PCN appear misleading and don’t reflect the actual situation as shown in the footage.

Could you please advise whether it’s worth pursuing an appeal, and what grounds for representation I should consider?

Please note I am not sure how to upload the video on this forum (I think I've managed to do it) additionally I have left my details so you can directly view on the council website.

Many thanks

Think you'll struggle on the contravention as the oncoming car looks to have slowed near to its priority sign. Sometimes adjudicators do give the benefit in marginal cases.

We've seen many cases here and you can check tribunal cases - recent ones should still have the video online.

It looks pretty clear from the video that you essentially chanced your arm here. Two cars pass OK, with you third just following. Look where you are when the appreoaching car is near the back of the sign indicating priority for his approach.
Not a winner, I think.

As per usual, pleas screenshot the payments page and report back. I believe their website is still not fixed.
I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
