PCN - failing to comply with no entry restriction

Hi everyone,

Few weeks back local council installed no entry sign on one of the roads (always been 2 way, now made 1 way) and i didnt notice it as the signs are installed very high and smaller size than normal no entry sign. No entry sign positioned above my windscreen, above 7.5 feet.

Do i have a grounds for an appeal du to the height of the sign and size of the actual sign?

GSV - https://maps.app.goo.gl/Kk1qA3G5JFFkYFJm8 (dated Oct 2024 so no installed signs). Dont have exact data of sign installation, but i visited that place about a month ago and it had no "no entry" signs yet. They have also installed camera against that street (no cameras before).

Are there No Entry signs on both sides, and are they illuminated ?

It does seem really stupid that they have put these new signs up barring entry, but the parking zone signs with times are still there !

Are there any advance warning signs in either direction ?

No other warning signs from any directions and signs are not illuminated but they are close to a lamp post. There is no sign from other side that this is now a one-way road. Speed marking are still on both sides.

You should submit reps on the basis that this new restriction is badly signed, with no advance warnings and all th e existing street furniture left in position, incl. carriageway markings. In addition, the new signs are not illuminated for such an important restriction.
You'll get the usual Fob-Off. Post their response when you get it. For a case like this you have to be prepared to stand your ground, forego the discount, and take them all the way to London Tribunals.

Not sure you'll have much joy here.A possibility is whether you are committed to the entry as the signs are set back and maybe not that visible from where you came from.

Edited. Worth checking their website as I seem to remember there are wrong grounds on it.

Red no entry signs are red so they do not get missed. Signs can be up to 4m high. I wouldn't fight this.

"controlled parking zone”

an area—

(i)
in which every part of every road is subject to a prohibition indicated by single or double yellow lines or single or double yellow kerb markings ..blah blah

AND

(ii)
into which each entrance for vehicular traffic has been indicated by the sign provided for at item 1 or 3 of the sign table in Part 3 of Schedule 5


This isn't an 'entrance for vehicluar traffic' because the 'No entry' sign means:

No entry for vehicular traffic!

I was misled. I noticed numerous signs, in particular the Controlled Parking Zone sign which, until recently, was placed to mark a vehicle entrance into the zone.

However, having viewed the council's video it is obvious that either this sign should have been removed or that the 'No entry for vehicular traffic' sign has been misplaced. As I understand it, these mutually contradictory signs are still in place.

Clearly, whether the location is or is not an entrance for vehicular traffic is still debatable and will remain so until the council removes whichever sign(s) should not be present.

Is my take.
