Hello,

First time poster! I have received a PCN from Hammersmith & Fulham Council for 52M failing to comply with a prohibition on certain types of vehicle.

It was very late at night travelling back from the Midlands through an area I'm not used to, following a sat nav and I didn't see the signs as they are not illuminated.

Any advice on if I have grounds for representation would be really appreciated.

Use of satnavs in London is very unwise if it takes you through the "back-doubles" because there are now restrictions everywhere in London; you must be constantly on the alert for closed roads. Satnavs are just never up-to-date. But I hear you say, "I updated it last week". Well, you may well have, but its the underlying data that tends to be out-of-date, and there's nothing you can do about that. Up here in Crewe, a new road didn't get onto my Jaguar satnav for well over five years !

Anyway, please tell us your approach to the restriction. Was it head-on, or did you have to make a left or right turn ? For a head-on approach they have put in an advance sign: -

The presence of this sign would diminish the strength of any reps you submit. You could submit reps based on the fact it was night and the signs were not illuminated. However, you'd need to back this up with photos taken at night from the motorists viewpoint. The council will reject them, and you'd have to take them to London Tribunals for a decision, with the full PCN penalty in play; no discount. It is this, or just cough-up the discount, like >95% of other people.
