Oxlow Lane Dagenham – contravention code 26

My son has been doing a college placement at Oxlow Lane in Dagenham. The staff all park along a section of wide pavement with all four wheels on the pavement.

This is directly opposite the Oval Practice/Oxlow Lane health Centre. Just leading up to the Eastbrook pub crossroads.

There is no signage to say that you can or cannot park with all four wheels on the pavement. Apparently it's just the "done thing" to park there and he was the only one ticketed.

He has parked along there multiple times and has had no problem until today.

The contravention states:

Parked with one or more wheels on or over a footpath or any part of the road other than the carriageway.

There was a whole row of cars in front of him parked in the exact same way that were not ticketed.

On his evidence photos the only thing I can see is that the section he parked on has double yellow lines in the road.

But the contravention doesn't say anything about the double yellow lines.

I'm wondering whether to and/or how to contest this.

He hasn't parked ON the double yellow lines. They are in the road and he is completely on the pavement.

Any advice greatly appreciated.

This is hopefully a permanent work placement so I don't want to leave it a chance that he may or may not get a ticket every time he goes there.

On his evidence photo you can see a white van in front, that wasn't ticketed, then there is a bus stop, and then all of those cars parked in front of the bus stop were also not ticketed, just my son.

Looking on Google Maps you can see that cars are always parked in this way along that section of the road. He was parked roughly where I've put the yellow cross.

So is it likely to do with the double yellow lines even though the contravention doesn't state that?

The CEO had a choice of penalties for where you parked, (1) parking off-carriageway, and (2) parking on a restricted street, because the DYLs apply to the whole road, mot just the carriageway. But for councils, they like choice 1 because there are no exemptions to it. We do see a lot of this sort of thing in B &D Coouncil who are duffers when it comes to signing and enforcing parking.

However, you've not posted the PCN, nor given us a GSV link so we can look for ourselves, sp please post them.

Councils can over-ride the 1970s London-specific Act that barred off-carriageway pwrking in London, but have to pass a resolution first, then sign where it is allowed.  B&D seem just to "tolerate it" it in certain places without doing any of the proper procedures.

Oxbow Lane is quite long so give us a Google Maps location.
