34j bus lane Newham

Hi, I need help to see if I can challenge this PCN. A car was turning right and I tried to go around. I was in bus lane for 2 seconds. The video shows the car turning and 2nd car Infront of me moved left to pass and I did same. Video and pictures clearly shows that I have moved back as soon as possible within 2 seconds. Thanks for all help and support.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

The problem you've got is that the car turning across the road to park is clear almost at the start of the video, yet you don't move back into the traffic lane, only moving out of the bus lane towards the end of the video. I think you'd struggle to convince an adjudicator, frankly.

I understand the video but it all taken 2 seconds. Car directly Infront of my car was indicating and I wasn't sure so tried to follow that car. Also the bus lane was ending after the bus stop. I understand what you said but it is clear to any human that I moved back to normal traffic and wasn't abusing the bus lane to avoid traffic. Thanks for your comments

I make the following challenge:

1. The alleged contravention did not occur  since the video does not show any advanced warning signage allegedly passed.

2. The alleged incursion is de minimis.

3. I put you to strict proof that the camera used is approved. If you cannot provide this, the evidence is inadmissible.

In light of the above, please cancel the said PCN.
