Evening all, looking for some advice on challenging a PCN i received last week whilst on a evening trip to Bristol.


On this street there is both loading bays and parking bays. I parked here at 16:45 and revived a ticket at 17:00. To me the signage is unclear with the parking part of the sign being separate from the loading part of the sign reads like parking restrictions are in place between 09:30-16:30 and you cant park in the loading bays between 07:00-9:30 and 4:30 - 6:30


I have drafted an appeal letter however I have zero experience in anything like this so unsure if I'm writing in the right way so would appreciate some advice on whether the wording sounds good in the appeal letter, or even if it is worth appealing.

"Dear Bristol City Council ,

I am writing to appeal the Penalty Charge Notice (PCN) mentioned above.
I disagree with the reason for the fine and want to explain why it should be cancelled.
I believe the incident mentioned in the notice is due to poor / unclear signage based on the road layout, especially for people who are not local to Bristol.

On Old Market Street, where I was given the notice, there are both, “On street parking bays” and “on street loading bays”. I have attached images of the signs and the loading bays, one the sign has 2 clear sections, one section advising no loading / no stopping, and a second section advising the times in which parking restrictions are in place.

To me, and to the person who i spoke to on the street who also received a parking ticket, and to the other vehicles that received parking tickets, one of which i have included a photo of, this signage is confusing and ambiguous the way that it is separated implies that the “No Stopping” applies to the loading bay, whilst the on-street parking bays are separate.

Perhaps the signage is the way it is intentionally to give people more tickets and increase revenue for Bristol city council, or maybe this is human error and the signage can be changed to make it clearer.

Either way, I disagree with the fine.  I kindly ask your team to consider the proof/s and cancel the fine within immediate effect and forward me a confirmation of cancellation.

Don't send that text off. You need to be far less confrontational. The sign by the parking bay looks most confusing. However, you haven't told us exactly where you parked, so please do so referring to a posted GSV link.

I have to say the signage looks a complete ****-up by the council and very confusing.

Forgot to say, my bad, I have attached where i parked here, it was in the parking bays in front of the loading bays. Not outside any lines.

OK, I've got it now.

It seems you failed to look at the No Waiting sign to the left of "25A Old Market" coffee & deli. The applicable sign at the top of the sign array. This sign applies to the yellow line running along the back of the bay. Your car is at the end opposite Chido Way. The PCN was served at 17.11 right in the middle of the afternoon period of No Waiting 4.30-6.30pm

So it seems you completely misread the sign. Starting from the top there is the No Waiting sign with restricted times, then, below that a No Loading sign with the same restricted times. The no loading sign is there to restrict loading which is allowed on yellow line restricted times, so there are yellow single kerb blips, one of which is visible in your photos of your car. Then below that the controlled parking hours, (payment required), that are between the morning No Waiting end time, and the start time of the afternoon restriction.  By deduction, there are no restrictions at all on Sundays and none Mon-Sat from the end of the afternoon restriction through the night to the start of the morning restriction.

So if you can give some explanation as to why you seem to have failed to realise the importance of the No Waiting sign, it might help us with text for representations.  Lots of people never seem to "see" No Waiting signs, and I suspect it's because it is announced as a symbol not by the words "No Waiting".

Apologies for delay in response, i work long shifts.

Because there were both parking bays and loading bays, where the sign said no waiting/no loading I wrongly assumed that those were meant for the loading bays whilst the parking sign about parking restrictions being 09:30-16:30 I assumed was for the parking bays.

The signs are still confusing, but I suspect you'd have to take them to the Traffic Penalty Tribunal for a decision.

The one by the stone arch has the same  No Waiting and  No Loading times as the other one, but has applicability arrows pointing to the right, yet the bay has no divider at that point. The other sign could be taken as applying to the loading bay.

Have a look at your text draft, and try to emphasise that the two signs for parking restrictions are not the same because of the arrows. Where these are used, it is to indicate that a restriction applies in the direction of the arrow, so there should be another sign alongside with similar signs with arrows pointing to the left, with different times.  Essentially, those arrows on the sign should not be there.
