Hi all
I receive a PCN outside my house in the following contravention stated 02a parked loading unloading in a restricted street we are waiting and loading unloading restrictions are in force
PC was issued at 7:28 in the morning and the residence permit holders starts at 8 o’clock in the morning and finishes at 9 o’clock at nine also to mention that I am a residence where the PCN was issued. I would like to know if there is any ground or appeal can be made

The PCN has been served as the parking and loading/unloading on the streets listed on the notice has been suspended under a Temporary Traffic Order. Did you not see the sign and read it ?

These signs always use the symbol for No Waiting, and then text for No Loading, as there is no symbol for this.

So please tell us more, like how long was the car parked there before the PCN was served ? Often, people park their car on-street and leave it there for many days, which is always taking a risk in London due to the frequency of parking suspensions.

If the notice was present when you parked, did you not read it ? The photo of the sign shows it started on 5th June at 07.00, but the lower part is not shown so the end date and time is not shown.  Its difficult to think of anything that you might submit representations on, as the notice seems clear enough.

Thank you so much for your reply and making time to reply. In regards to the CPZ when they are suspended are the parking sign  meant to be covered?
thanks

It is not normal practice to cover the parking signs, because the suspension signs are put up in advance of the actual suspension to give proper notice

HI ALL

ANY THOUGHTS OR HELP REGARDING THE PCN WOULD BE MUCH APPRECIATED AS I WILL NEED TO SEND OFF MY CHALLENGE TO THE COUNCIL BY WEDNESDAY

THANKS

This is the wrong contravention. It should be for a suspended bay or space, just deny the contravention
I help you pro bono (for free). I now ask that a £40 donation is made to the North London Hospice before I take over your case. I have an 85% success rate across 2,000 PCNs but some PCNs can't be beaten and I will tell you if your case looks hopeless before asking you to donate.

Dear council.

I am re submitting my challenge in regards to the alleged contravention 02a parking or loading unloading in a restricted street. We are waiting and loading unloading restrictions are in force as per PCN referenced "xxx", on grounds that the contravention code is incorrect for bays that are suspended for reasons of maintenance or otherwise, as informed by the council

In light of the above, please cancel the PCN with immediate effect.

Thank you

I would like to know if anyone can advise as I will be resubmitting the challenge, thank you for your thoughts and advice

Your latter sentence (above) does not make sense?

You now have to wait for the Notice to Owner before you can challenge again
