Greenwich, 34J Bus Lane, Bugsby's Way SE7
« on: »
Hello,

I turned into a bus lane before I was due to turn left and drove for 20-30 meters in the bus lane. Just a simple mistake. This took place on Bugsby's Way outside the Makro. Is there any hope of appealing? I have just received the enforcement notice, I somehow did not receive the initial PCN letter in the post.

Hm, you sure it was just 20-30 metres, it looks longer in the video ? Anyway, it seems a fairly obvious contravention. Any reason for entering the lane early ?

If you are prepared to take them all the way to London Tribunals, our Hippocrates has developed a winning appeal based on a clause in the 1996 Act which is shown at the top of your PCN, but I'll let him explain it. But first you must submit representations to Greenwich against the PCN. I wouold suggest that these be based on only driving in the buslane for a very short distance in order to turn left. They will, of course, refuse these.

We need the other side of the EN and all the PCN too.

I do not know what you first challenge was but I suggest this:

I make this formal representation against the PCN and EN. The alleged contravention is not supported by the video evidence as there are no upright signs allegedly passed. Please cancel both documents therefore.

Finally, in this legislation they MUST attend a hearing when required by the appellant (or me!) and their evidence must be watertight too. These days they are not contesting many many appeals at the Tribunal in any case.

The full enforcement notice pl(all sides and not cut off at the bottom).

I somehow did not receive the initial PCN letter in the post.

More details pl. For example, are you the registered keeper and is the enforcement notice addressed to you correctly?
