Gateshead Council Bus Lane - High West Street (Northbound)

Good afternoon,
I received a PCN from Gateshead Council on 10th Jan for the alleged contravention - Code 34J Being in a Bus Lane

Background : Major arterial bypass road was suddenly closed just before Christmas due to severe structural issue.

Incident : During the holiday period 28th Jan, was my first time driving route since bypass road. Suddenly i had to diver into the town center roads. The entrance to High West street did not indicate it was a Bus only road, as there was a Bus lane next to a lane open for private vehicles. Suddenly the open lane ended and the Bus Lane was merged to the lane I was traveling. By the time I processed the Blue Bus lane sign, had already entered and almost exited the Bus Lane.

It appears I am liable, but can you suggest any grounds of appeal.

Today (31st January) is the last day to pay the discounted PCN, if that's the only best option. I did try to make representation online but was overwhelmed by the basis of representation (added to end of PCN link)

Not much we can do when you post on the last day of the 28 days ! Why didn't you come on here earlier ?

However, this is an advance warning sign, but if one zooms in to the road leading on from the cross roads, there are no Buses Only signs. So it seems the bus restriction has not been signed correctly or the restriction is somewhere along the road ahead. Trouble is GSV then gets out-of-date, so really we need to see the video, their sole evidence of the alleged contravention. If it's online you and us can look at it by entering PCN Number and car reg.So please unblank these details. On postal PCNs only name and address need be redacted.

Apologies for last day posting, was dealing with other issues and kept putting of dealing with the PCN. Accidently blanked the reg while uploading, did type in the missing details at the end. Here are details below

Yes there is a video of entering the Bus Lane just before the traffic lights.

Having now looked at the video, this is the location where the bus gate is located : -

It is located 187 metres past the traffic lights with the advance sign, but GSV is dated September 2020 so the bus gate signs aren't shown, nor the text "Buses Only" on the carriageway.

The only thing I can see that is missing from their evidence is the video doesn't actually show you passing the signs, because the camera shows cars approaching the restriction. This could be put forward as no evidence of a contravention, but the council would probably then put library photos into their evidence pack if you take them to the Traffic Penalty Tribunal. You have the absolute right in law to do this, but must risk the full PCN penalty if you do so.
