Author Topic: Forty Ln/Mount Dr HA9 ticket for being in a BUS lane during an event day  (Read 553 times)

The hours of operation for this bus lane are Mon-Sat 7-10am and 4-7pm and on event days 7am till Midnight. I drove on the bus lane on a saturday at 12:17pm. There were no signs to say it was an event day. On the PCN video and pictures also it does not show any signs on either side of the road. I can't understand how a driver is supposed to know when it is an event day. The council has responded that there are digital warning signs on the main routes into the event day Zone and Motorists can check dates on the wembley stadium website. Firstly i didn't see any such digital sings, secondly i was coming from Barnet and chose my route home as I was driving. Do they expect the drivers to stop and go online on the website to check for the events?
As they have rejected my appeal, can anyone suggest if i should challenge as I strongly feel this PCN is wrong.

Most London bus lanes PCNs can be challenged on lack of camera authorisation - our member Hippo knows about this.

I can't see how they can enforce this anyway - how can they refer to 'digital warning signs' that are not part of the statutory signage.

Hello, I have today received the 'Enforcement Notice'. I have to now send in my representation. I intend to say that i had no way to know it was an event day as there were no posts anywhere to advise of it. The council in their previous letter say that it is the driver's responsibility to know ahead of driving and check the Wembley website, but i didnt know i would enter an event day, it is impossible for the drivers to know ahead of time unless you live in the area and know to check.
I would welcome any advise before i send in my response.

This is an absolutely absurd restriction for moving traffic. Somebody could be in his way home from France to Scotland and would have no idea whatever about "event days".

Actually they damn themselves in their reply, by saying you must go and look on their website, and also, as 'Stamfordman' points out, look out for a sign giving the dates when this is not a traffic sign. Motorists are under a duty to obey traffic signs, as listed in the TSRGD, and nothing else. If they wanted to show Event times for the bus lane, then the actual bus lane signs should show them, but again, this would not be a traffic sign.

Your case really needs to be taken to London Tribunals where I'm sure you will win, not least because you can insist that the person who signed the video record attends the hearing. They never do.
