Equita warrant Enforcement
« on: »
Good Afternoon,
Following your recent correspondence, the content of which has been noted.
We have been instructed to enforce a Warrant that has been issued by the Traffic Enforcement Centre (TEC) in Northampton. Previous notices have been sent to you by both the Local Authority and the TEC.
We are unable to answer any queries with respect to the issue of the Penalty Charge Notice, or with regard to the issuing of the Warrant. Our instructions are to collect payment in full, or to seize goods belonging to the person named on the Warrant. If you wish to dispute your debt, we recommend you seek independent legal advice from your local Citizens Advice Bureau or another independent advisor/solicitor.
We cannot hold action whilst you make your enquiries and so you must contact us with your intentions or proposals for payment. Failure to do this will result in your account being passed to an Enforcement Agent and additional fees will be incurred.
Regards,
Equita

Basically, I parked on a road which was apparently for DISC holders only and I wrongly assumed my Blue badge would allow me to park there.
I was in Keswick on holiday and when I got back I could not find the ticket.
I emailed Equita and asked them to check blue badge holders were not allowed to park there and also gave them my registration number so they could notify me as I did not have a ticket number.
They did not reply.
I chased it up with them 5 days later but they did not reply again.
Then they emailed me the warrant which is shown above.
I emailed them back and said I never said I would not pay it, just wanted to make sure it wasn't a mistake

Can I challenge this at all?

Thanks

Welcome to the Forum.

If you have received a Notice of Enforcement, pl post (see READ THIS FIRST at the top of the front page). In any event, what is the date of the Notice(NoE for short) and the latest date for payment with only the Enforcement fee added?

As you were issued with a paper PCN for a parking contravention the process is set out here: https://www.londontribunals.gov.uk/eat/understanding-enforcement-process/parking-penalty-charge-notice-enforcement-process

I did read that but as I lost my ticket and contacted them which they acknowledge in the warrant statement, I was unable to pay the ticket unless they supplied me the details which they didn't

The enforcement process ends with the issue of an Order for Recovery and a warrant to enforce the debt.

The authority instruct a 'bailiff' to enforce the warrant. Their first mandatory step is to issue a Notice of Enforcement notifying the debtor of the debt, the instructing authority, the amount of the penalty, the Enforcement fee(£75), a reference which gives the PCN number(which can be used to check on the authority's website and hopefully see the PCN progress log showing every stage to the OfR), a latest date for payment of the debt including Enforcement fee and guidance on next steps.

I don't know what you mean by 'ticket'.

If you have contacted the bailiff, then presumably you were prompted to do so by a NoE?

Only thing I had was a parking ticket which I lost so couldnt pay.
Hence the reason why I contacted them.
Other than the email which I copied in above, they have failed to reply for two weeks

What date was the contravention.

This looks like you do not have an up to date logbook as you are missing at least three letters including the notice to owner, which is sent to the registered keeper if a windscreen PCN is not paid.

Go get your V5C logbook and check the address.

12th January the ticket was issued by a traffic warden
23rd of January I informed them I had lost the ticket
I have had nothing in the post from them to reply to and all they had to do was give me the ticket number and I could have paid it but they didn't

So that warrant is not related to the PCN from Jan - the NTO will only follow next week, 4 weeks after the PCN.  Is your V5C up to date with the your current address?

You need to find out which local authority and the PCN number the equita warrant applies to.  Not sure, but if they won't play ball with details, then you may need to get on to TEC to find out.  You also need to find out what address the warrant is made out for.

What was the first contact you had from Equita. You say you emailed them but after what?

This may be a scam.

OP, can you please post the actual documents not transcriptions of them. At the moment giving meaningful advice is almost impossible.
Also please answer 'stamfordmans' question aboout your V5C Registration Certificate.
