Entering and stopping in a box junction when prohibited Street
« on: »
Hi All,

I hope you are doing well.

I've been fined for being in the yellow box junction with my car. I challenged this and my appeal got rejected.

I am writing to formally appeal PCN issued. After reviewing the video evidence, I would like to provide detailed context to explain the circumstances that led to my vehicle entering the yellow box junction. 1. Timeline of Events: o At 0.07 seconds just at 0.08 serconds my car was stationary , my vehicle was stationary, with the rear wheels touching the edge of the yellow box. o The traffic light transitioned from amber to green as I entered the box, indicating it was safe to proceed. o At 0.08 seconds, the first car in the line began to move forward starting the flow of traffic. o The second car behind the first started moving at 0.09 seconds, and by 0.10 seconds, other cars ahead also started moving. o At 0.11 seconds, the third car visible in the video moved across the junction. o At 0.12 seconds, the fourth car ahead of me was delayed in moving forward, causing additional traffic slowdowns. o From 0.14 seconds, the second-to-last car in front of me also began moving with some delay, further affecting the pace at which I could clear the junction. 2. Traffic Light Pattern & Anticipation: I entered the yellow box during the transition from amber to green, anticipating that traffic would continue to flow. This is consistent with the expected traffic light pattern and my intention to move forward promptly once the way was clear. 3. Minimal Stationary Time: I was stationary for a brief moment, approximately 0.01 to 0.02 seconds, before moving forward. My decision to enter the box was made in anticipation of a clear path, but the slow movement of traffic delayed my ability to clear the junction. o My vehicle is longer than the average car, which may have caused my rear wheels to remain on the edge of the yellow box briefly. Despite this, I was actively moving forward as traffic allowed and did not obstruct traffic flow. 4. No Obstruction: At no point did my vehicle obstruct traffic flow. My rear wheels were briefly on the edge of the yellow box due to the delayed movement of the vehicles ahead. However, I ensured I was turning right, and my entry into the box was made in anticipation of traffic moving forward, which it did, albeit slowly. The purpose of yellow box junctions is to prevent obstruction and maintain traffic flow. My actions did not obstruct other road users or cause congestion. 5. Mitigating Circumstances: I entered the box during the amber-to-green transition, a reasonable decision based on the traffic light pattern and the movement of cars ahead of me.The delayed movement of the vehicles in front was beyond my control and caused me to remain in the box longer than anticipated. My actions did not hinder other road users. 6. My Driving History: I have always adhered to road laws and have maintained a clean driving record with 0 points on my license. I am diligent about paying any fines on time and ensure I follow traffic regulations responsibly. I fully understand the purpose of yellow box junctions and have always made a conscious effort not to block them under any circumstances. In this particular case, I feel that I was delayed by factors outside of my control, such as the slow-moving traffic ahead. The purpose of yellow box junction regulations is to prevent congestion and ensure smooth traffic flow. My actions adhered to this intent, as I entered the box under safe conditions during the amber-to-green transition and moved forward as soon as it was possible to do so. I respectfully request that this PCN be reviewed and cancelled, as my presence in the yellow box was momentary, non-obstructive, and caused by circumstances beyond my control. Thank you for your time and understanding. Should you require any further clarification, I would be happy to assist.

Now I feel like a nancy and may have appealed over my stupidty but thought i ask for advice as my father thinks I should appeal it further.

I looked at the video, and the contravention would seem to be made out, but you need to post the PCN, all sides, with only name and address redacted. We can then check it for fatal errors.

Lots of appeals are won even though it's clear the contravention occurred, because there is a legal process and legal duties on councils that they often ignore. They have to obey the law same as you, and if they don't the PCN is void.
