ENFIELD COUNCIL PCN PARKED WITHOUT PAYMENT
« on: »
So I was parked without payment but the location on the PCN is incorrect. The photos taken are also evidence of this. The stated location is about 3 roads further, so I am wondering if i can appeal on the basis that the alleged contravention could not have been committed as i was not at the location stated. Google maps verifies this and so do the photos of the PCN. I have attached the PCN below and a screenshot of google maps and where I was actually parked vs the location stated.

Looks promising but - any Council photos on Enfield's site? If so, please to post them here.

Ive just attached the photos to the imgur link, and as you can see the photos do not correlate to the location stated, so should i go ahead and informally appeal?

Can you match the location in the photo purporting to be Hazlewood Lane to a GSV screenshot of the same view on Aldermans Hill?

You want to be able show that that you were there at the time time stated, so as to write something along the lines of "As can be seen from the CEO's own photographs (copy enclosed) at the material time I was on Aldermnans Hill (see attached screenshot)."

Wrong location is fatal to a PCN, and they cannot re-issue.

would be a start!

I know you've posted a plan, but I prefer the above!

Ive written a draft and will also attach the screenshots from the imgur as evidence. What do you think?

Dear Enfield Council Parking Office,

I am writing to appeal the Penalty Charge Notice (PCN) issued on 31/10/2024 with reference number EF14556973. The PCN cites a location of alleged contravention as Hazelwood Lane, which I can confirm is incorrect, as I was not present at this location at the specified time.

I believe this PCN was issued in error and request that it be canceled for the following reasons:

Incorrect Location on PCN: The location mentioned on the PCN does not align with my whereabouts at the alleged time and date. I have gathered evidence proving that I was elsewhere during the stated time, which I have attached for your review. As can be seen from the CEO's own photographs (copy enclosed) at the material time I was on Aldermans Hill (see attached screenshot) opposite KBK studio.

Compliance with Traffic Regulations: As I was not present at the alleged location of the contravention, I could not have breached any traffic regulations or parking restrictions there. I kindly request that the council review this matter and acknowledge that an error has been made in issuing this ticket.

In light of this information, I respectfully request the cancellation of this PCN. I am confident that the evidence provided clearly supports my claim that I was not in the location at the time of the alleged contravention.

Need to change it throughout so it refers to your car not being at the location not you!

Thanks, how about now?

I am writing to appeal Penalty Charge Notice (PCN) number EF14556973, issued on 31/10/2024, concerning an alleged parking contravention involving my vehicle. The PCN states that the car was located on Hazelwood Lane at the specified time; however, this is incorrect, as the vehicle was not present at this location.

I believe this PCN was issued in error and request its cancellation for the following reasons:

Incorrect Location on PCN: The location listed on the PCN does not align with the actual whereabouts of the car on the date and time specified. I have provided evidence showing that the vehicle was on Aldermans Hill, opposite KBK Studio, at the time in question. This includes the CEO’s photographs and an attached screenshot showing the vehicle’s precise location.

Compliance with Traffic Regulations: As the car was not present at Hazelwood Lane, I could not have breached any parking or traffic regulations there. I kindly request that the council review this case and acknowledge that an error has occurred in issuing this ticket.

Given this information, I respectfully request the cancellation of this PCN. I am confident that the attached evidence supports my claim that the vehicle was not in the location indicated at the time of the alleged contravention.

Sorry, but too convoluted for me.

I refer to the PCN and CEO's photos.

Whereas the PCN gives the location as 'os 6 Hazelwood Lane' your photos show my car parked opp KBK Studio 32-36 Aldermans Hill.

Given that there is no evidence that my car was parked as alleged, the PCN must be cancelled.

For ease of reference I attach a copy of your photo and a GSV shot of 'os 6 Hazelwood Lane'

OP, what more needs to be said?
