I parked in a permit holders bay got out of the drivers side door to check I was in the space. I was satisfied by the faded markings (you should see the state of road markings / roads in general around here) and I left the car for a week.





During this time I recieved 2 PCNs on the 8th and the 9th for not parking within the bay markings, which have been badly repainted sometime ago and then patched over without being reinstated.

Post the PCNs.

Could be a continuous contravention. Normally in England you'd get a higher level yellow line PCN if wheels on line but I think contraventions in Scotland may be all one level.

Oddly, you've been served a PCN for not parking correctly in the bay, rather being on the yellow line. Clearly part of your car is in the parking bay, (but not much !). Penalty is £100, so if the penalty for a yellow line contravention is higher the CEO has done you a slight favour. There are no signs for the yellow line which makes me thing this street is within a CPZ. A short investigation shows you are in CPZ 4, but Edinburgh Council's website won't tell me what the controlled hours are ! However, this is irrelevant as the PCN is for not parking within the bay.

So how clear are they now ?  You haven't shown us a photo of the bay itself

It used to be a small area for some kind of street bin but it is on yellow line.

We'd to see the traffic order to see if the given contravention is valid.

There is a yellow line map as below - can you work out if that yellow line is the same as street as maybe the bay should be longer.

The road markings have changed somewhat recently, with the bin bay no longer being in operation. I have annotated the map of the yellow line markings as best I can but I don't know how accurate the map is to begin with. Although it generally looks OK, the start location of the yellow line seems off.

Update: I believe I have found the most recent TRO dated May 2024, which includes the relocation of the communal bins last year.
Based on this map tile, there is no legally enforceable yellow line where i parked past the corner of No.4 :D
Infact the permit holders bay extends maybe 3 car lengths past the faded road markings.

I will need to write to the council to confirm, as they do not keep a list of all current TROs on the website  ??? I will also need to decipher TTRO TEMP/23/142 for the construction works to check for conflicts. Does anyone fancy a look?



I believe this merits a glass of Scotland's finest Cooncil Juice (Tap Water) in celebration.


If that is the current TRO then it does seem like you were in the permit bay, the street markings are wrong, and the contravention did not occur.
