Free Traffic Legal Advice

My son received a PCN from City of Edinburgh Council for parking outside Ingliston Park and Ride. On arriving the at the park and ride it was full (due to a rugby match) so he parked on the road (along with a lot of other cars) leaving the park and ride that leads to the motorway.

The PCN was for 'parking on a pavement' but technically he was parked on the grass verge next to it. On google maps the lane shows as a bus lane, but from the photos he took the road appears to have been renewed and he was not aware of it being a bus lane (although it could possibly still be). Finally, there does appear to be a no stopping sign a little further along the road.

Probably clutching at straws, but if the PCN was for either the bus lane or no stopping- fair enough. But, technically the PCN was issued for a questionable reason given he wasn't actually on the pavement.

Any advice greatly appreciated.

And, like the 1970s Act that barred off carriageway parking in London, it needs no signs or lines, plus the council will no doubt parrot the mantra "ignorance of the law is no excuse". Trouble is there is an awful lot of law around in 2024 !! Not only this, the mantra I have posted has no basis whatsoever in law, so you can happily submit reps that you had no knowledge of this new Scottish law.

Even if they relent to this could they change the offence to one related to to the new stopping sign (which I assume would be enforecable) or do they need to stick to the offence they have cited me for? thanks

Your best bet is probably a polite ask for discretion owing to the newness of the change in law.

The capacity of the park and ride could also be mentioned or some kind of event warning about rugby etc.

I presume they will reoffer the discount on rejection.
