Good afternoon

I went over to ealing on thursday and parked on a residentual road with no markings or yellow lines. I went to see a friend who just moved there so not aware of restrictions yet. I returned and found a pcn. I then happened to notice a sign which was facing away from the street so in all honesty I did not notice it. Is this actually legal?

I removed the vrn for the time being as don't want my reg and car posted up in the thread but will do if needed just wanted initial thoughts please.

It's in a controlled parking zone and it looks like the parking bay markings are mostly non-existent and probably not compliant.

We need to see Ealing's pics and a Google Maps location.

You'll need to confirm your registration number so that the Ealing photos can be obtained from their website, or maybe you could do that and save them in the Google drive folder?

Ive put the unedited pcn in the drive. I couldnt download the images in a decent res. Thanks

The bay lines can just be made out but I don't think they are good enough. The parking sign is obviously turned 180 degrees from the road.

Ealing will probably say you went past a CPZ sign so should have known there are restrictions.

If Ealing tells you the sign gives the full details of parking, then they are talking tosh, (as ever). All the CPZ sign tells you is no waiting on the yellow lines within the zone during the times on the sign, that's all.  ALl marked bays in the zone must have a sign.

Ok thanks. So I'll appeal on the grounds that no contravention occured based on the lack of bay markings and yellow lines plus the signage not appropriate?

Contravention did not occur.

There is no clearly defined cpz or appropriate signage. A cpz should have clear markings to define the space included in the restriction. There were no yellow lines or other markings to determine any further resctrictions. The sign should also face the street and be clearly visible. This sign was turned by 180 degrees and therefore invalid. Please cancel immediately.

Pl forget about CPZ, as already posted it's irrelevant to the contravention.

Having reviewed the authority's evidential photos, it is clear that the contravention did not occur because in order for this contravention to occur based upon the information in the traffic sign road markings are mandatory, these being Item 6 in the Part 4 sign table here: https://www.legislation.gov.uk/uksi/2016/362/schedule/7

There are no such markings in evidence and therefore the contravention did not occur and the PCN must be cancelled.


They'll huff and puff while they're judges in their own cause and if they dragged this out to adjudication I'd apply for costs.

The CPZ is relevant, but to Ealing.

I would make it a more conversational challenge.

I am challenging the PCN as the alleged contravention did not occur.

As evidenced by your CEO's pictures, I parked on what I could only see as an unrestricted extent of the carriageway. There are no marked parking bays there.

I see the CEO took a picture of a parking sign but on checking Google Maps this sign appears to be facing in the opposite direction to the road!

As no mandatory traffic sign and road markings were there to alert me to a parking restriction the PCN must be cancelled.

And may I respectfully suggest you task your CEOs with reporting defective parking restrictions rather than issuing non-enforceable PCNs.
