Subject: Formal Appeal Against PCN J
Dear Sir/Madam,
I am writing to formally appeal against the Penalty Charge Notice JK1 issued to my vehicle, registration number Y, on 17/09/23 in Dulwich Park Car Park for contravention 73U.
Grounds for Appeal:
Insufficient Signage:
As shown in the attached photo, the main sign at the car park entrance does not clearly indicate that it is a pay and display car park. The small reference to payment is easily missed, especially for someone unfamiliar with the area.
Upon parking, I did not notice any additional signage indicating the pay and display requirement. While escorting several young children to the football pitch, no further signage was visible.
The Traffic Signs Regulations and General Directions 2016 require that signs must be clear, visible, and understandable to motorists. Key points include:
Visibility: Signs should be easily seen by motorists upon entering and throughout the car park.
Clarity: Information on payment, restrictions, and penalties must be clearly stated without ambiguity.
Legibility: Signs must be in a readable font size and style.
Consistency: Signage should be consistent throughout the car park to avoid confusion.
As my attached photographic evidence demonstrates, these guidelines are not adhered to at Dulwich Park Car Park.
Other Notes:
I was transporting members of my son's football team to Dulwich Hamlets FC, assuming the car park was for the football club where parking typically does not require payment.
I was extremely stressed due to the traffic on the A205, making the team late for the match and was in a rush.
I would have paid using the required parking application if the signage was in place. I have all the applications, including RingGo, set up on my phone. This was not a case of avoidance of payment.
I have medical conditions under treatment that affect my ability to notice and respond to such signage promptly. This also contributed to the duration of the appeal process.
I have been unemployed for the past eight months, in part due to my medical issues, and the family finances are under extreme pressure.
Attached are the photos and a video link that further support my claim regarding the insufficient signage.
I kindly request that you review this appeal and cancel the PCN based on the evidence and circumstances provided.
