Author Topic: Haringey - 11u parking without payment, got ticket while trying to download app to pay  (Read 9 times)

Hi all, hoping for some advice please. I parked in a pay a display bay, and while trying to download the right app for the borough, register my vehicle and pay for the right zone (while sat in the car) all over the course of a few minutes, received a PCN from a Civil Enforcement Officer.
They sent me photos from just one time stamp (10:26).



I initially appealed with the following.
I know it's probably not the optimal response but I thought it would do the trick as the PCN seemed very unreasonable.

"None of the photographs submitted as evidence in this PCN show any evidence of parking. There is a car stopped in a bay, with no evidence of duration of stay. The driver is within their rights to observe local road rules, signs, and understand payment charges. Payment charges in Haringey as you know are handled via online applications, which take time to download, create accounts and register cars with. Please submit any evidence that this car was parked here longer than a judge would find reasonable to download a >100mb application, sign up for an account, register the vehicle, add payment methods for parking, find the correct parking zone, submit a request to park, find out the actual payment cost at this stage, and then to make a decision about whether to park. There is no evidence submitted suggesting the driver left the vehicle during this period. This PCN amounts to nothing more than harassment of the individual driving the vehicle and trying to understand the rules to park on this particular street, as there are 4 or 5 different zones within a <0.5mile radius."

What are my next steps, do I need to appeal to the Parking Adjudicator? Does the London Tribunal come into it? And what should I say? I don't believe their response is reasonable at all. They claim the CEO has observed the vehicle for 7 minutes, without any proof that my vehicle the stationary for that long. They say that this is more than sufficient time to make a payment for parking which I haven't seen written anywhere in any parking legal frameworks.

Would be grateful for any advice.
