Order For Recovery of Unpaid Penalty Charge

Hi all,

*** I AM UNABLE TO UPLOAD ANY FILES! IT SAYS THE SYSTEM IS FULL! ***

I'd really appreciate some help with the following. I received an Order for Recovery of Unpaid Penalty Charge for a PCN that I never received or have any recollection of having previously received:


I filled in a Statutory Declaration stating (PE3) that I never received the PCN and witnessed by a solicitor before sending it by email to Tec@justive.gov.uk.  I then received an automated reply from TEC stating the following:

"Emails are processed in date order (Oldest to newest) and we are unable to assist you in the following circumstances;

      • If you don't have the PCN, you will need to contact the Local / Charging Authority, or their enforcement agents, to confirm
      this information. We cannot help you with this." (See attached email)

My question here to the FTLA forum is, does the above bullet point mean that the Traffic Enforcement Centre will not cancel the Order for Recovery of Unpaid Penalty Charge, and do I now still have to get in touch with the London Local Authority, i.e. Hounslow Council to also inform them that I never received the PCN?

Please also show us your TEC submission. What was the PCN for ? If you've used the wrong form they will reject it.

As far as I can see, you have submitted the SD by, I presume email,  and must now let the process at TEC run its course. There are severe delays at TEC so as your SD was dated 4th October, it would seem early days yet.  As far as I can see, all that email is, is a response to your email submitting the SD. It might be prudent to call them to confirm they have received the SD in the email.

Hi Incandescent, many thanks for the advice.  Do you think I should also still send in the signed Statutory Declaration by registered post too?  Or is sufficient to know that I've emailed it in to TEC@justice.gov.uk?

I don't think you need to send the paper document, but it would be prudent to contact TEC to ask them if their email you received is their normal response to emails, and to also make sure they have your signed and witnessed SD.

I noticed this too; I can't see a court or solicitor's stamp on the form you sent?

IMO, the OfR along with the email uses incorrect terms which could confuse.

PCN - penalty charge notice.

NOT, Penalty Charge No. (meaning number) as given at the top of the OfR.

A penalty charge is a sum of money, not a number.

So OP, the email means gives out a generic warning that if you (the Respondent) do not have the penalty charge notice number then TEC could not process the SD because these are indexed by PCN number.

But phone anyway if you want to confirm.
