IMO, there are procedural improprieties in the PCN.
1. The regs provide:
b)that if, before a notice to owner is served, representations against the penalty charge are received at such address as may be specified in the notice for the purpose those representations will be considered by the enforcement authority;
The PCN states:
'..penalty charge must be paid or your challenge received within 28 days...
B******s.
IMO, nothing else in the PCN amends this gross procedural impropriety. So there's one line for your reps.
No-one cares a toss about Dartford's policies in this matter - referred to often in the PCN- because they're not the Enforcement Authority, this is Kent CC.
So, I suggest you find out who at KCC administers this agency arrangement and find out KCC's policies as regards:
Challenges made outside the 28-day payment period;
Whether the discount may be re-offered in the case of unsuccessful challenges or formal representations against a NTO.
Do KCC have agency arrangements with other districts and boroughs in the county.
Send a copy of the PCN, less the particular details of time, contravention etc. and ask them to confirm that they have authorised this form of PCN to be issued in their name.
Or for £35 chalk it up to experience.
