I paid three days late for a crossing on 6-9-2023. NINETEEN WEEKS LATER I receive a PCN today. Are they out of time here? Surely there is a time limit beyond which a crossing PCN cannot be issued? They cannot just sit on it forever
There is no time limit in the Road User Charging regulations on service of a PCN, but clearly, as it also acts as a Notice to Owner, any reasonable and alert adjudicator would regard service after nearly 6 months as an abuse of process. In your case, 19 weeks, nearly 5 months, this is clearly unfair and you should submit reps on this basis, but also the PCN itself can be considered unlawful by demanding the toll in addition to the penalty charge.
