Dart Charge 4 Charge certs no notice of rejection

Hi,

I forgot to pay two dart charge crossings one on 6th July and another on 22nd June and received a PCN for each , the reason I did not pay on time is my credit card had changed so my dart charge account didn't take the auto payment .. this has happened a few times so i knew an appeal would probably be rejected but I tried anyway

I appealed within the time frame and was waiting for what I assumed would be a notice of rejection , I didn't receive this and did think it was strange and just thought maybe they were taking longer than usual

then on 23rd September I received two charge certs , I was very confused as I had not received a notice of rejection so i called dart charge and explained and was told to simply follow the process of appealing again online which is what I did on 23rd September, also my first appeal was there on their system so it had defo been registered

i took a screenshot of my 2nd appeal and then heard nothing until today two more charge certs! and again no notice of rejection

i have rang them today and been told i should have not appealed again but i should have contact the traffic penalty tribunal and explain the situation and appeal .. which to be honest they are probably not going to believe i didn't receive the notice of rejection

i have tried to appeal and apparently my PCN numbers are invalid? they match exactly what it says on the charge certs and I have tried numerous times , i didn't even have the pin needed to appeal and had to get this from dart charge on the phone

also why was i not told to contact these ppl when i called on 23rd September! i have asked for a recording of that phone call as I want to use it as evidence in my appeal

where do I stand on this? I am happy to pay the original fine of £37.50 x 2 but I genuinely did not receive a notice of rejection and I was also told wrong information by the dart charge rep when I first called

Number plate is VX16 KMA BUT I
Blanked it out before reading the rules. I only have the first  pcn for the 6th of July crossing not 22nd June as I can’t find that one. I don’t have any notice of rejections just these charge certs

Not receiving things like Notice of Rejection of Representations is commonplace, you are definitely not alone, and there is a process to get the matter reset to the PCN stage: -

You must now wait for the debts to be registered at the Traffic Enforcement Centre. This allows DART to issue an Order for Recovery to you, one for each PCN. You can then submit a Witness Statement that you submitted representations but did not receive a notice of rejection of those reps.

Now, here's the key thing; you do not have to receive the actual Orders for Recovery in order to submit the above form (TE9). You can submit them once TEC have recorded the PCNs. As you have missed receiving the rejection letters it is clear there may be a mail issue, so best not to rely on receiving the OfR. So you must be proactive from now on, and ring TEC regularly, (about every 7-10 days) to find out if the PCNs have been registered. DART can only register the PCNs after the period for payment of the Charge Certificates has expired. Be careful to check this date for each CC which tells you when DART can apply.
Other thing to say is, don't try submitting TE9s before the PCNs are registered, as TEC will have no record of them and will reject them.
Finally, on the form, the "Applicant" is DART, not you.
