Contravention Code 16 - Redbridge
« on: »
I received a PCN today for entering a permit zone. I was totally unaware I had entered the permit zone. As there was no markings on the road and I was unaware I had entered a permit zone I parked my car there for 10 minutes.

Tracing the route that I took to get to Mansfield road, I note that there is a sign there however I argue that is not reasonable to have read the contents of the sign due to where it is placed. You are turning in from a busy junction (double decker busses and pedestrians). When driving past the sign it is also blocked by the blue sign in front.

Further to where my car was parked on Mansfield road there is a sign saying it is a permit area but please note when I got out my car I walked towards Beal road and there is no sign(I also wouldn’t have thought to look for any signs as I was unaware I was in a permit area)

Location - Mansfield Road Ilford - (51.5614026, 0.0677791)

So essentially, you're arguing about adequacy of signage. However the council will argue it is totally adequate, so will refuse your representations. All the regulations say is that the council must erect sufficient and adequate signage to convey the restriction to motorists. "Sufficient", and "adequate" are subjective, so the only unbiased forum open to you is to take them to London Tribunals, (the adjudicators) and argue your case. The council will also argue theirs, and the ajudicator will make a binding decision. To do this, you must risk the full pCN penalty.

@Fightback please give us the PCN number and the number plate, please see the guidance here.

Also please post the PCN in full, and it's easier if you embed the images into your post, the guide I've linked above tells you how to do this.

We also need a link to the location where the zone sign is, and if the sign itself is not on GSV then we need some wide angle photos take from further back showing the visibility of the sign from the main road.

I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.
